Real Estate peope/Lawyers.... Question

I am not sure what else to do and I am looking for advice. I am trying to sell my co-op and the management company is doing nothing to assist. All of the buyers paperwork has been sent to the management company and they have sat on it for the past three weeks. My r/e agent was calling everyday trying to get them to process the paperwork so that the buyer can get an appointment with the board. She was promised it would be done over a week ago. I called the management company again last Friday and asked if I could pick up the paperwork to submit to the super to get the interview arranged. I was told I couldn't and that they would mail it out on monday. Well my r/e agent called them yesterday and they said they woud send it out express that day. Well today, they have not done anything. We already lost a previous buyer because of this and it looks like we will loose our current buyer. Is there anything I can do. I am getting desperate.

Do you have a RE Lawyer? If not, I suggest you get one and put him on them ASAP. It's obvious that their lack of cooperation has deterred buyers from your place and that's unacceptable!

I do have a r/e lawyer, however I don't feel like this is something he wants to deal with. The last time this has happened, I asked him if he could do something to help and he basically said that this wasn't my problem but the buyers. This time he said the same thing, but said he would write a letter saying that we will sue if they cause us to lose this buyer. This was yesterday, we are waiting to see if he indeed fax over this letter. The lawyer just doesn't seem like he wants to help us and I want to go elsewhere, but the lawyer is my DH's family lawyer and he thinks he will help.

No offense, but it sounds like you need a new lawyer. It seems as though he doesn't have your interests at hand. It is NOT the buyers problem if they are doing their part and providing the board with all the necessary documentation.

Instead, you should hire someone who is going to get the board to cooperate.

No offense taken. I totally agree with you. Unfortunately my husband still fills this guy will help. I might just start looking myself.

I would call up a few in the area and ask them what their opinion is on the situation. No need to ruffle anyone's feathers. You're losing $$ by not having someone retroactive. That's not good.

The holdup is with the management company. There is really not much your lawyer can do except call and badger them.

You can try a new lawyer but if the management company is uncooperative you will probably have the same issue.

I had the same issue. The lawyer can't do much if the management company is not cooperative. My lawyer and real estate agent as well as myself constantly called. My buyer missed 3 or 4 meetings with the board after her paperwork was in. They just didn't look at it or call her. I had to make all those extra maintenance payments for an empty co-op and my buyer had to redo her mortgage twice. I'm still shocked she didn't walk away from the sale. I hope you are able to do something, I know how frustrating it can be.
