The teen who videotaped sex with another teen...
Anyone hear about this? He was 17 at a party, and someone taped him having consensual oral sex with a 15 year old girl, and then he went to jail for 10 years???? THEN, he was goping to be released a few days ago, and they stopped it and want him to be in jail another 8 years????
I don't get it!!! Rapists and sex offenders get out sooner than this! It doesn't make sense!!!!
Is it because she was younger? Or because it was taped? I mean, teens have sex all the friggin time with each other - how could we ever just put them all away???? And it was consensual!!!

I heard about this the other day. Aside from everything you mentioned - consentual, time served, harshness of the sentence, etc. The laws in GA changed and this would now be a misdemeanor with a much shorter sentence. I don't really recall the specific details and why his sentence was so harsh and why the atty general is not willing to let the boy go free now.

Story
Actually - he has only served 2 years of the ten year sentence. If the case doesnt get thrown out he will have to serve the remaining 8 years of the 10 year sentence. I feel bad for the kid, they have already ruined him. How unfortunate.

I have not heard this story, but the sex cannot be consensual if the girl is underage.
but all that jail time is ridiculous.

It was because there was an outdatd law in Georgia (where the incident took place) that stated even if BOTH parties were underaged and it was consensual, it was still a mandatoryu 10 year sentence.
The law was just changed which is why he was initially released, but the DA in the case reversed the release.

This is not true. The age of consent varies from state to state but is generally between 16 and 18 years old.
Here is the law for NYS: According to Article 130 (Sexual Offenses) of the New York Penal Code, if the perpetrator is over 21 years old and the victim is under 17, this is known as third degree rape; if the perpetrator is 18 or older and the victim is under 15, then this is second degree rape; and, if the victim is younger than 11 years of age, then first degree rape has been committed.
So, in NY a 20 year old and a 17 year old can have consensual sex. And in the case described, a sex act between a 17 year old and a 15 year old would be legal.

I believe it was the law at the time that the event occurred - because he was 17 and she was 15. Since then, GA has changed the law, but they have not changed his sentence.
