Renters rights ?

Is there such a thing? Can they just raise there rent to whatever they want..??? Or is there an allowed percentage increased?

Here is the thing...

We rented our apt 2 yrs ago- on a special @ 1398/month our lease is up in July- and we are thinking of renewing- but Ive been told its increasing to 1650Chat Icon

I called the rental office this weekend- pretending to be a perspective new comer- and was told my very same apt. is 1450... (On a special)

I just dont understand why my rent would jump so high- when they are renting it out to people off the street for so much less...

My Mil says i should just move out and move back in to get the new price

I mean we are not talking 25-50 bucks we are talking a difference of $200/monthChat Icon

Im gonna talk to the manager on Monday- but just wanted to see if there were any rules for this kinda stuff...

TIA

I dont think there are any rules. This is probably what they do to get people in. They figure once your in its too much trouble to move so they will be more likely to get the higher rent then, then if they had asked for that much up front. If you got in on a "special" I am pretty sure that was their intention.Chat Icon

Re: Renters rights ?

I don't know about NY, but my apartment in NJ was rent controlled, but they were allowed to raise my rent 4% each year.

I would definately say something to the management office as to why they are offering a lower price on the same apartment compared to what they are raising your rent to!

In NY if your apartment is rent controlled or rent stabalized then there are rules about what percentage the rent can be raised (based on renewal or vacancy).

Unless you are rent-controlled, they can raise it to any amount they choose.

Look at your lease, it should mention if there are any restrictions on how much they can raise the rent.

When I lived in Hoboken, our building was exempt from the rent control laws of the city because they offered a certain percentage of apartments as low income housing at a much lower rate than what they were charging other tenants.

rent controlled and low income housing are not the same thing. I certainly did not live in a low housing area when I lived in my apartment. It was just a deal that was struck between myself and the renting office as to why my apartment was rent controlled.

You would know if your apartment was rent controlled.

I know the area you live in and you are not rent-controlled.
