question about FMLA and disability

we FINALLY have a disability policy at work, it starts in January of 2010! Chat Icon Chat Icon Chat Icon Chat Icon Chat Icon just in time for when we plan to have baby #2

i know that it is 6 weeks for vag birth and 8 weeks for c-section.

my question is, does it coincide with FMLA? as in, do they start the same day? or can i use FMLA and then use my disability? (or vice versa)

The way it was explained to me by my HR area was that the 6 or 8 weeks was PART of the 12 week FMLA, even though I get paid for the 6 or 8 weeks.

So if you had a vaginal birth and went back to work after 6 weeks, you would then have 6 week of FMLA left to use at a later time if needed.

yeah that's how it was explained to me.. so I was out for over 13 weeks..
8 of which were disability and paid as such the rest I had other benefits to cover the salary but only the first 12 were protected by FMLA for job status.

so coincides i guess is the answer.

It's probably best to call your HR dept directly to ask, because mine said something different than the other responses here. We have to take 2 weeks PTO first, then 6-8 weeks disability kicks in, then you take any other leftover vacation time you have left, THEN you can take the 12 weeks FMLA after that.

Policies are different from company to company, so i think for the most correct answer, you should probably call your specific HR dept.
