Is This a Violation of a Patient's Rights?

For the ladies..

If you went in for your routine pap smear, and found out your doctor performed tests that you did not ask for or consent to (basically swabbed you for other things as well), would you consider it a violation of your rights as a patient?

If you think so, what would you do about it?

yes. You need to be informed of any tests that are being done before they are done.

I would be upset. My old gyn had done this to me. They tested for a whole bunch of things. When I came back for my next visit they told me the results I was a bit upset. When I go for a pap, I assume they will do whatever is routinely done along with it. I probably would not care on a personal level, but as a lawyer, yes, I am offended. I have to dot my i's and cross my t's and doctors should, too. That means explaining what they are doing and allowing you to opt out.

That sounds odd -- did you sign some sort of waiver? I would definitely talk to your doctor about it.

I know there are certain tests that they do need consent for such as HIV, but I don't think that they test for these things to be sneaky, but to make sure that everything is OK down there. Lets look at it the opposite way, if they didnt test you and you had something and it caused permanant damage would you sue them for not knowing? I think with lawsuits nowadays they are just covering thier bases. I would think that most of them would just tell you that they do these tests routinely, but I guess some of them dont or assume that people know they are getting them?

As long as my insurance covers it and no tests come back bad, I don't care what they test for.

Just through general conversation with my dr though it seems like they test for more than they used to on routine exams.

ETA: At my gyno's office, at routine exams they do a pap, pelvic exam, breast exam some routine STD checks down there and I think that's about it.

No, I didn't sign anything.

I called for my regular pap. I ended up with an appointment with midwife in the practice that I HATE. DH came with me because we don't trust her.

She does the routine stuff, but then (may be TMI) puts a small speculum in, and swipes wtih 3 different swabs. Then she said, "I didn't get the cells I needed from your cervix. I'll have to use the larger one and swipe again."
Then she uses the larger one and swipes again 2 more times.

I didn't think anything of it, but when I looked at the sheet she gave me for all the stuff she did, she tested me for gonorrhea, chlamydia, HPV (4 different tests) and my regular pap.

I'm most upset because she totally lied when she used the smaller speculum. She knew that she was testing for something I didn't consent for, but tried to make it seem like it was nothing.

I probably would have consented to all the tests if she had told me about it, but I feel kind of violated that she did things that I didn't know about and then tried to be sneaky about it.

nah I trust them , and if they are t4esting for more, i would feel its in my best interest anyway...

I thought HPV testing was a routine part of a pap?

As far as the STD testing, its odd not to ask, but I do think many offices do it as routine events w/o asking and I wouldnt care ...is it a violation? Not sure....

Just so you know, the Pap is an HPV test and you would want to be tested for all four types. God forbid you had a type of HPV and weren't tested for it and it turned in cancer...
As far as the STD's, I thought that was a routine yearly thing.Chat Icon

that sounds normal to me but I understand that you were thinking it was just going to be a pap. That's normally what is done for me when I go for a pap.

I understand how you feel. I felt the same way when I found out -after the fact- that an HPV test was done for me in addition to the regular pap. I had no idea that test was being done, and even if it is protocol, I should have been informed of this before getting the results. I was really surprised and upset this was done without my knowledge. I would have consented, but I wasn't given the option.

i'd be happy they tested for extra things. better safe than sorry.

if you got charged for stuff you werent expecting then id be alittle tiffed, but i dont know. i just let them do what they need to do and pay my bill.

I requested the HPV test in November (at my 6 week check-up after DS). Thats why I was confused about that test. I also had the STD tests at the end of my pregnancy which was less than 1 year ago.


I guess its routine, I just felt upset that she didn't tell me what she was doing since the other midwife does. I feel like I should know what you're doing when your fingers are in my private area Chat Icon

I dont recall being told about a specific HPV test and I couldn't care less. But if I wasn't given the right diagnostics way back when, I could be dead right now. Sorry if that sounds harsh but I had HPV and if I wasn't diligent about my reproductive care, I could be one million times worse off than I am now. I am grateful my doctor did what he had to do.

I think they always test for these things together. I always thought of the pap something that included all of those things.

I wouldn't be upset though. It probably is routine.

And there is nothing you can do about it legally.

These are all standard tests at a routine visit. I dont think you need to sign a consent form; you dont sign a consent form for a pap smear every time you have one.

I don't think that's true. I have not been tested for these at my annual GYN exams. If they do anything other than the PAP they tell me. For example this year she offered me the new HPV test where you dont have to get a PAP for 3 years if it's negative. I know I would be very annoyed if they did testing without my consent. Very annoyed.
Legally I don't know what the rules are though. I know you have to consent for an HIV test but I'm not sure what else.

Sorry - but isn't a pap test testing for all those things anyway? Why go for your yearly if you arent going to make sure you are completely healthy? I say test me for everything - I'm there anyway - whats the difference? Its not like they are donating my cells to science or anything...

ETA - whenever you give blood for anything, they almost always test it for HIV - whether you request it or not... Also, if you go to a dr. for any concern, they look for a whole bunch of things you may not have signed a waiver for - but thats what happens when you go to someone who is watching out for your health.... I mean, when Cailen was whisked away from me at the hospital, I didnt sign a waiver for anything (except for the Hep shot, which I chose not to do at the hospital) - but I knew they were making sure I had a healthy baby, and thats all that mattered. I didnt even sign anything for his hearing test - I'm not going to sue them for making sure his hearing was ok... that would be insane!
