i need help guys and i am sorry i have not been around in a long time
My husband is is brookhaven hospital after suffering a huge stroke on friday. i am is a real hard place and a rock place!!! I need a lawer asap for power of atterney and a order of protection from his family! please if anyone can help please fm me!!!! i am in a VERY VERY bad place with no money and i need to get my house cleaned of mold and mildew and handycapp accesable. my foundation broke and i am scared.!

I don't know any lawyers in Suffolk. I believe to obtain an order of protection, you need to go to the police precinct to start the paperwork. Document any incidents as to why you think you would need one, that your safety is being threatened etc.
I'm not sure why you would need power of attorney. I believe being married to him gives you more right than his family would regarding his care & assets (including the house).

Is the house in his name? You are legally married, not common law, right? (there is no common law in NYS I believe)
etd to ask: Does he have any children outside of your marriage? Your children are his?

I'm sorry to bring this up, and Janet, I am VERY sorry for what you're going through right now - but she DOES need to get POA. As we all know from the Schiavo case, it is VERY important to have a living will before anything happens.

If you want to make decisions for your husband's health then you would need a health care proxy, so that you can make all decision for him but I believe being his spouse gives you that right but you don't want to get into a situation like the case in FL. As to power of attorney it would give you financial rights. If your husband owns things that you don't then you would need power of attorney to manage those type of things--based on what he choose to give you power to you would be able to sell things. The other thing is I don't know the state of your husband at this point and to get either he must be able to sign his name & a doctor to say he is competent to sign those documents.

My dad used someone to get POA from my grandmother but it was an elder care atty. I'll try to find out his contact info tomorrow.

my husband is unable to respond almost in a coma like state. he hears you a turn to noise but that's about it. he is only 34 a non smoker and drinker very healthy

if you are his NOK, you will be looked to to make all medical decisions, financially, do you have a joint bank account and other accounts (credit cards, loans, insurance etc?). I'm hearing of these young people being struck with horrific ailments all too often, I am so, so sorry that you have to go through this!

You need to go see a lawyer IMMEDIATELY. You won't be about to get a Power of Attorney now that he's incapacited so you are going to need to be appointed as a guardian by the court which you will need a lawyer for. I would also change every lock on the house just in case his family has keys. You don't want them in there, picking through stuff.
I'm so sorry for everything you are going through. I have you and your family in my prayers.

As his spouse you should be listed as his NOK and able to make all decisions regarding the medical care he needs.
As far as the house if your name is not on the deed or on any type of will then you will need to get POA.
You may have to declare him incompetant but I dont know how that works. When my grandmother got my great grandmothers house my grandmother willingly gave POA to my uncle and she was a secondary name on the deed. When my grandmother became ill my uncle had to take her to court and doctors had to test her to see if she was incompetant to make any decisions. (She has the early symptoms of dimenta and hardening of the brain arteries) When the results came in he was given full POA. I dont think her name is anywhere on the papers.
Each situation is different and your best bet will be to talk to an attorney who will know the system. I have a wonderful attorney in Queens but he deals with accidents. I am sure if you call him he'd give you the name and number of someone he knows who could help you.
I am sorry you have to go through this
