Why is it that even with a c section I only get 12 weeks maternity leave?

I am out on maternity leave and originally the deal was 6 weeks disability and the rest would be FMLA. My job would pay a percentage of my salary while out on disability and then for FMLA I would use all of my vacation time and the rest would be unpaid.

I ended up having a C section so shouldnt I now get 8 weeks on disability and still get 6 weeks FMLA?

My job is saying I only get 12 weeks. Because of the c section I will get 8 weeks at disability pay and then the remaining 4 are part of FMLA. So I will use my vacation time ( 3 wks) and 1 week unpaid.

FMLA is still 12 weeks regardless of what kind of delivery you had.

It had nothing to do with the disability of 6 weeks for vaginal deliveries or 8 weeks for c-sections.

FMLA is not just for pregnancy. You can use it for medical conditions, taking care of a loved one. It's up to 12 weeks per year. You can split it up or take as a whole

My company only pays 6 weeks maternity leave no matter what kind of delivery you have

FMLA is only 12 weeks total.

You are lucky your job pays anything. A lot of people just get the 6 or 8 weeks disability and then the 6 or 4 weeks to complete the FMLA unpaid.

And my old job didn't even have FMLA.

Your maternity leave whether it be 6 or 8 weeks runs concurrent with FMLA.

In order to get paid during FMLA, and if your employer allows, most make you use vacation or sick days.

My employer doesn't pay disability even for maternity leave... you only get paid according to the amount of sick days you have banked... I had 103 days (after 11 years) but some moms may only have 10.
