(CNN)President-elect Donald Trump proposed on Tuesday a penalty -- including possible jail time or loss of citizenship -- for burning the American flag, in spite of two US Supreme Court rulings that protect the act under the First Amendment as a form of free speech.
"Nobody should be allowed to burn the American flag -- if they do, there must be consequences -- perhaps loss of citizenship or year in jail!," Trump tweeted.

The Supreme Court twice affirmed the right to desecrate the American flag as a form of free speech -- a historically contentious issue -- in cases before the high court in 1989 and 1990.
In the 1989 case "Texas v. Johnson," the Supreme Court ruled 5-4 that flag burning was a form of "symbolic speech" that was protected by the First Amendment. The ruling was granted after an appeal from Gregory Johnson, who had been convicted by a Texas court of violating a state law that prohibited the "desecration of a venerated object" such as the US flag.
The following year, in "United states v. Eichman," the Supreme Court again affirmed the right to burn the flag when it ruled 7-3 that the Flag Protection Act of 1989 -- passed by Congress in response to the Johnson decision -- was unconstitutional.
When asked about the Supreme Court rulings on CNN's "New Day," Trump transition spokesman Jason Miller did not respond to questions about the constitutional protections of flag burning.
"Flag burning should be illegal," Miller repeatedly told CNN's Chris Cuomo.
Hmmm... haven't other world leaders tried jailing citizens for using their free speech?...

I think it's terrible to burn a flag. But it's protected. To threaten someone's citizenship over it is scary. And it's a slippery slope- it's not long before journalists who write things he doesn't like get jailed.
This is also a distraction- I think he thinks people will not probe his allegations of voter fraud. And his HHS pick is awful.

It's like watching a whiny, cranky, clueless toddler running the nation. 
Every time I see one of his infantile and moronic tweets I just cringe and shake my head. He's literally stumbling through this entire transition without a clue and it's just scary. What's worse, it literally doesn't matter what this idiot says or does OR who he appoints into his cabinet..................his "sheep" followers are right there cheering him on chanting their horseshit about "Making America Great Again" and "Draining the Swamp". It's absolutely comical to me that ANY of them think this billionaire narcissist will be acting in the best interest of us ordinary, every day Americans. SO foolish.
I STILL cannot believe this is actually happening, it's like watching an episode of Punk'd, I keep waiting for Ashton to pop up and tell us it's all been a bad joke and that we can relax now...............a REAL president will be stepping in shortly. The thought of listening to this baboon for 4 years makes my stomach churn and I just dread the mess he will SURELY make of this country.

Yes!! I hate Pence and in some ways I wonder if he's more dangerous b/c he actually knows what he's doing. But at this point, I feel like he will MAYBE try to be an adult and work with the others. Maybe it will be just for show, but at least we wouldn't have this clown at the helm.
I don't know, it is definitely a lose-lose for everyone, but maybe a slightly less embarrassing.
