Old claims is there a length of time that your no longer responsible for?

My dh keeps getting calls from claim agency that bought some info from Discover card he never had. They say we owe them about $1200.00 from 8 years ago. DH has never had a discover card and never got any letters or bills from discover card saying he owed this money.. doesnt come up on his credit check. They keep harassing us saying they have my dhs last 4 digits of SS#. And that he has to pay this money.

How can I get them to stop calling, we told them several times dh did not have a discover card. The calls wont stop.

Since they said this is was about 8 years ago, shouldnt that be enough to stop the calls?

I have no advice but that is nuts. I would tell them to stop harassing you if you never had a discover card.

Make sure it is not a scam. Ask for there # and call them back and ask to speak to a head supervisor to get to the bottom of it all.

Well first, don't offer his last 4 digits of his ss#. Sounds fishy.

Have them give him the acct number and all the information this is under. If they can't do that, then there is something up.

Have them send you proof of the bill which would show your DH's name and the amount/charges on them.

If they cannot provide you with proof.........then too f'n bad.

As far as their harassing calls........probably not much you can do except dont pick up.....or repeat the same story over and over.

Is the number they call from Private?

ETA: If they know your DH SS#....are you asking them what it is? Have them tell YOU. Don't give them info but you probably know that.

Also, get their mailing address. You can appease them and say sure I'll send you the money. What is the address? This way maybe you can start from there. The more info you have, the better for you.

The number comes up unlisted on caller id, and they said they only had dhs name/ and last four digits... not entire #. Dh didnt give them any info and told them to send copy of this so called bill.. all they sent was their bill. Since its not showing on dhs credit info.. im not paying a dime, but want the calls to stop. They call 2 times a day .. we dont answer calls and they dont leave message on machine.. which is another reason I find fishy.. If its soo important why dont they leave a message?

This is not a good idea. IF this is legit and you make that statement they have you dead to rights for admitting this debt.

tell them you want all future correspondence in witting and to stop calling. That is harassment and if they call again they will be hearing from your attorney.

I've done this and it works.



I told dh he better not agree to paying anything, and for them just to send proof of such claim.

when my dad was getting calls and stuff like this -- he wrote them a letter informing them that if they didn't cease all actions of collection -- he was forwarding the letter to the NYS attorney general's office as part of unfair debt collection practices and harassment.


they never called or sent another letter again.

That sounds so odd! Is DH SURE he never had an account w/discover? You said its not on the credit reports which is good, but it may have been at one time. When it passes 7 years after date of last activity, negative items drop off. So it would make sense its off now.

At any rate they cant' do anything to you (sue you or take wages etc..). It's too old of a debt IF it were even his.

Go on www.creditboards.net They have great info on there. You can start with writing a letter asking for validation adn where they got their info. It would make me furious to be harassed for something that wasn't mine!!!

Get their information (name and address)... then sue them.

If they are a real collection agency, sue them under FDCPA in small claims and collect $1000 bucks in FDCPA violations.

If they are not a real collection agency and possibly a scam artist, sue them under TCPA and collect anywhere from $500 to $1500.

I wish these people would call me. I have projects that need some monetary infusion. Chat Icon

You can call discover and ask if any off these records actually exist. I would also let them know someone pretending to be them is harassing you, I'm sure they do not want impersonators scamming with their name. Perhaps Discover will sue them also.
