Ok lettr to company about leave..

i want to write a letter so I have it all on record..I wrote this up as a draft for now..does this cover it all. I want to but a spot on the letter for management to sign also. this is just a draft.




I will be taking 2 weeks vacation (April 24-28 & May 1-5) prior to the 6 weeks paid maternity leave I have been given by the company and then an additional 6 weeks disability. My first day of Maternity leave will be May 8th 2006 I will receive pay up until the week ending June 16, 2006. I will then be taking an additional 6 -7weeks off (depending on how long it takes for disability to take effect) unpaid in which I will mail the company a check for $133.23 per week to cover my family medical plan while I am out. If all goes as planned and I can arrange for proper child care I plan on returning to work August 7, 2006.

6 weeks disability will come before 6 weeks paid maternity? Also I would remove this sentence...

If all goes as planned and I can arrange for proper child care I plan on returning to work August 7, 2006

You don't want them thinking you might not come back because they might not be as accomodating as they would if they think u r going to return to work.

No maternity leave will come first then my disability. i kind of put that sentence in to hint i probably will not return.

Now I don't know anything about this, but are you eligible for NYS disability if your company offers you maternity leave? I would double check and just verify that there are no rules about what needs to come first, etc...

Also, why do you want to hint that you will not come back? I wouldn't do it. If you decide not to come back, you can always give your notice during your maternity leave. JMO.

I just assumed paid leave would come first. they told me once my leave is up I can get disability. even if I do not get the disability I am taking 6-7 weeks additonal off.

Make sure you doctor is willing to sign off on disability. Also, i would not mention getting disability in the letter....it makes them see that you are assuming you are getting disability and that is not always the case.

Also, i would not mention the day you are coming back.

One more thing...you are assuming you are going to go on your due date. If you go earlier they might start maternity leave (paid 6 weeks) and then you can get the additional 2 weeks of paid vacation time afterwards.

Sorry my company is not so strict about this. They know my estimated due date and will work around that.

ok i revised it a little:

I dont know, just my opinion, but I wouldnt want any of this in writing. I would want to know from the company what I am entitled to - and get that in writing - but I wouldnt want to write down what I plan on doing and the exact dates and times that I will be out.

Also, my company doesnt start maternity leave until the baby is born...so if Im out before then its either disability or vacation.

By writing all of this down, you are really locking yourself into this set schedule that you may or may not be able to keep.

IMO I wouldnt do it.

I would definitely use "approximately" or "on or about" around the dates. You never know when you will give birth.

I don't think you can get NYS disability after 6 weeks of maternity leave because you have to file within 30 days of your disability. I would check on that.

I changed it so it just tells my dates i start my leave i just want to have proof that i ma being paid the 6 weeks and let them know i will be out 6 weeks additonal. I will try to file for the disability if I don't get it then i don't get it by i am still taking the time off.

I had my entire maternity leave in writing. Unless you have a specific employee handbook that outlines what you are owed while out you could not collect without a signed letter. I wanted everyone to be very clear about my leave and payments. But I would NEVER included anything about daycare or possibly not returning.

I would revise this a bit:

Currently I am due on XX, using that as a basis for my maternity leave dates the following is how I will be taking my maternity leave:
2 weeks vacations (April 24-18 & May 1-5)
6 weeks of paid maternity leave as per the company policy
6 weeks of FMLA as per company policy
My expected date of return is XX
I understand that during my 6 weeks of Family Medical Leave (unpaid time off) I will be required to send a weekly check in the amount of $133.32 to cover the cost of my family health plan.
Of course, if I deliver my baby earlier than my due date these dates will be slightly revised. The amount of maternity leave will not change, just the actual dates.
If you have any questions about my maternity leave please feel free to contact me.
Thank you again for your time and assistance in this matter.

Will you be available for co-workers to call or e-mail questions while you are off? If so I would include a brief sentence about that in the letter.

oh that is good thank you. I just want it in writing for me because we are a small comapny and do not have any set rules.

Then you need to change the part about the FMLA. FMLA only covers companies with 50 or more employees.

I would change that to:
