Can someone help me find a link ?
Not FMLA

ETA: I'm wondering if the 6-8 weeks is only post pregnancy... what if I'm unable to work just before?

I dont have the link, but I think its 6-8 weeks total, meaning up to 2 weeks before.

not really sure if this is true for everyone but two people I know just had this happen to them and they had to take FMLA for the time before the birth then STD kicked in after the birth. HTH

My job told me that STD (the 6-8 weeks) can not start until after the delivery.

Crashing, but I work in HR so I can explain:

If you are disabled BEFORE your due date (i.e. bed rest) - that does not count towards the 6-8 weeks post partum.

The 6 weeks is for a normal, no-complications vaginal delivery and the 8 weeks is for a normal, no-complications c-section.

The total amount of time you are 'legally" allowed out of work is 12 weeks under FMLA (your company may allow you to take more) and you have to have worked there more than 1 year and a few other parameters.

The time out before and time out after all count towards the 12 weeks total time away from work.

Being paid during any of this time depends on your company policies. You can file for state disability but many companies offer benefits more generous than that. Most only pay you for the time you are "disabled", not the full 12 weeks you may choose to remain out of work.

My HR person told me if the doctor orders me out of work early, I can start claiming STD. This will not take away from the 6-8 weeks that I can take after the birth.

My boss told me that 2 months was to long to be out on maternity leave. That her other employees took one month only. I dont think I'll b ready to go back in one month expecially if its a c-section.

Are we legally entitled to at least 6weeks?

I believe your company has to have 50 employees or more in order to be mandated to the FMLA law. Double check though b/c I could be wrong. If they do have more than 50 employees they MUST abide by the FMLA and can't deny you the 12 weeks.
