NYC DOE employees leave question

I am so confused...

I thought I could use all of my days saved (28) plus borrow 20 days. The payroll secretary (who is pretty good and knows her stuff) told me I can only use my days and borrow up to 30 days total. Meaning I will only have to borrow 2 days, but then won't get paid after that.

Can I go on disability after that or after 6 weeks, I am out of lunch and just home without pay. I was planning on taking 3 months but will only get paid for 6 weeks even if I have days I can still borrow?

Also, spring break falls in there...I'm guess I don't get paid for those days do I?

Hope this makes sense...the DOE website is useless and I just want to make sure I don't miss out on anything.

The whole DOE policy is VERY confusing. You can only get paid for your actual "maternity leave" - your maternity leave is different from the Family Medical Leave Act (FMLA)....it is either 6 weeks or 8 weeks, depending on if you have a c-section. So if you have a vaginal birth and you have enough days in your bank, you can use 6 weeks worth of those days (that's where the 30 days come from) and I think you'd be able to get paid for 8 weeks if you have a c-section. But once your "maternity leave" is over, you can't get paid for any more days, even though you'll be taking off more days through the FMLA.

The only way you can go on disability after the 6 or 8 weeks is if you actually have a medical condition after the birth of your baby that entitles you to disability - but most likely you won't be entitled to disability after unless something is wrong.

Are you working until you give birth? Or are you taking off a week or two before? If you take off a week or two before, your FMLA begins then and you will start using your banked days then. So if you take off 2 weeks before, you will use 10 days and then use your additional 18 days after the baby is born and then you can borrow more days until the 6 weeks are over.

If spring break falls within 6-8 weeks after the birth of your baby, you won't have to use banked days for that...but if it's within your 12 weeks of FMLA, you won't get paid for that.

This is just the understanding that I have, but you might want to check up just to be sure.

You won't get any information on the DOE website as maternity leave is a benefit through the UFT, so check out their website and you'll find a lot more information. You can also call your local UFT office to get information as well.
