Madeleine McCann's mother is being made a formal suspect by police investigating the child's disappearance.

The move was revealed as Kate McCann, 39, who emerged early on Friday morning after almost 11 hours of questioning by Portuguese police on Thursday night, prepared to face officers again. A family spokesman said Mrs McCann expected to be made an "arguido" - a formal suspect - when she returns.

Mrs McCann, who looked drawn and tired when she left the police station, was said to be upset at the development. Her spokesman said: "She is shocked and surprised in several ways. First of all, that such an accusation could be made against her. And obviously she is concerned that such a line of investigation can become a distraction from further attempts to find Madeleine."

Her brother-in-law John McCann said the prospect of Kate becoming a suspect was "unbelievable". Speaking from his home in Glasgow, he said: "We just need to see what exactly is going to develop in Portugal. We just want to see exactly what the Portuguese police are saying. We cannot believe the line that they are going down - we just find it unbelievable."

Until now there has only been one arguido in the case - expatriate Briton Robert Murat.

Mrs McCann was questioned at the headquarters of the Policia Judiciaria - Portugal's CID - in Portimao on Thursday. Before she left the police station, detectives told her they had further questions to ask her which would require her to be given arguido status, the family spokesman said.

Mrs McCann will return to the police station at 10.30am and her husband Gerry is due to be interviewed by officers separately at 2pm.

Under Portuguese law, an arguido has legal protection that is not extended to a witness, including the right to remain silent during questioning and the right to legal representation. It is not uncommon for people caught up in criminal investigations in Portugal to declare themselves arguidos in order to receive this protection.

Mrs McCann left the police station accompanied by her lawyer Carlos Pinto de Abreu and her sister-in-law Trisha Cameron. She did not say anything to waiting journalists, but Mr Pinto de Abreu insisted she had not been named as a suspect, saying: "Kate was held throughout the whole day as a witness and she remains a witness. It is obvious that investigations will continue, and I cannot say anything else because of the secrecy laws."

Throughout her four-month ordeal, Mrs McCann has invariably been seen clutching Madeleine's favourite soft toy, Cuddle Cat. She was holding the toy when she arrived at the police station on Thursday afternoon, but did not have it in her hands when she emerged.

Her prints and DNA are sure to be all over EVERYTHING in that holiday villa...

I just don't get this...

Me too. Chat Icon Weren't both parents out to dinner when she disappeared?

I saw this on Larry King last night. there were some "experts" on the show saying why wouldn't her mom's prints be all over the villa? they were staying there.

I know this is going to sound harsh, but I've always thought the whole story was off. I mean, you were SOOO concerned about your kids that you didn't trust any of the babysitters the hotel recommended, so you decide to take off and have dinner somewhere albeit close by, but still out of eyesight and hearing? Just does not add up to me.

I always thought the mom was off a bit. No one leaves their kids in the hotel room alone in lieu of a babysitter, unless one of the parents needed an alibi.

Not being funny, and I would NEVER do this personally, its very common to do this in Europe. Again, I wouldn't do it, but I know a lot of my colleagues and friends have done this in the past. I hate to think that they are involved (I wouldn't dicount it until its all solved) but it isn't something that is out of the ordinary. The holiday camp they were staying in was very posh, these aren't stupid people...

Wow, that's interesting. I didn't realize that. As you saw on parenting, over here people call the cops if your kid cries walking into the house, so I just couldn't imagine anyone doing this.

I saw a news program this morning that said if she is offically named a suspect, they can ask her additional questions that they can't ask unless she is a suspect. It is the way the law works over there. They also said being named a suspect over there is not the same as being named here, what ever that means.

CNN just reported that the girls blood was found in a rental car the parents used 25 days after her disappearance.

I thought the same thing since day 1. DH and I were on vacation in Ireland and saw this story on the news the morning she went missing. We looked at each other and said "we don't even leave EACH OTHER alone when we're in a foreign country. What kind of idiot would leave a CHILD alone?"

I agree totally.

Could it be possible, just like a Jon Benet situation, that the girl was accidentally killed and they tried to cover it up for fear of repercussion in a foreign country? Just guessing...I always thought the story was VERY off.

I mean, what if your child wakes up and falls? Or has a bloody nose? Or wakes up worried, looking for you? A 4 year old alone in a hotel room, upset and confused and scared out of the mind when they see they are alone in a strange place?

I am sorry but anyone who would do this is insane.

I agree, I always thought the parents were "off". Who would leave their kids in a hotel room to have dinner. Something never added up with them.

the news mentioned they have like 22 questions for her and in order to do it they have to name her a suspect.
One of the question were..."Did u sedate her?"
Soo..maybe they think she sedated her and she wouldn't wake up while they were gone...
unreal...your parents are soppose to be the souls on earth u can rely on always...

actually, this is common in Europe, according to what I saw on CNN last night. they were 100 yards away at a nieghbors villa
