I am hating Bank of America right now
So...I deposited 2 checks in the ATM on 4/1...one for $318 and 1 for $864. I got a letter in the mail on 4/10 saying that my ATM deposit was incorrect and they are taking the $864 out of my account. Basically....they lost the check! They were in the same envelope...how could you lose 1? I've spoken with customer service and the branch itself...
The check was from NJ state...we called the state and they said that they couldn't track the check because BOA said we need to provide copies of the front and back of the check. So...since the state won't provide me with the check because they say they can't...I'm out $864

are you sure you deposited it? I did this at Chase the other day and I thought I put a $700 check in the envelope and it was actually sitting on my dresser. I got so mad at Chase (hey why not-they screw up everything) but it was my fault. 
I had two other checks with the deposit and I was sure I had it in there..
Either way-I hope you can find a resolution. Can the state stop the check and issue you another?

I am 1000% sure I deposited it. I have my copy of the deposit slip that shows the 2 checks listed. The state says they can't do that....the state check is also underwritten by BOA, so as far as the state is concerned...BOA can find the check.

this is why my husband REFUSES to make any deposits thru the ATM. 
sorry this happened to you kim!! 
if the state sees the check was never cashed, will they re-issue another one??

In a letter I would demand a manager obtain copies of the video from the ATM machine at the date/time you put the checks into the machine. Tell them they cannot charge you the "research fee" for doing this since it is their fault that they lost the check. Then, if they see you put both checks in demand your $$$. I would send this letter by certified mail to the bank manager. I would also bring in a copy of the letter to the bank and make an appointment with the manager to personally review the tapes.
Additionally, check your pocketbook or any other place where you keep the checks, just in case you accidentally mislaid the check before putting it into the envelope.

My DH has already been to the branch and spoken to the branch manager...he was helpful and said he would look into it. Took copies of everything we had, the letters from BOA, my deposit slip, etc. When speaking to the claims department on the phone, they said the branch manager can't do anything. We must provide the front and back of the check that was deposited or else we don't get the money back. They don't care what the state said about not being able to give us this information. I told them I will close all of my accounts including my HELOC if they take out the money...they said go ahead, they don't care. I said you realize if I close my HELOC, you will lose more in interest in the first month than this check is worth (with the interest rates being so high, I'm paying over $900/month in interest).
There is a history of this type of check being deposited...it's my DH's unemployment check from the state...every 2 weeks like clockwork, it gets deposited. They said they can see a history, but it still doesn't matter.
I will sue them for my $864

I have done this also....my DH has been on the phone with BOA for almost 2 days straight....there's no budging them.

In all my years of banking, I have never had a problem depositing in the ATM.

First, I don't believe that the state cannot reissue the check. They can stop payment on it & reissue it like any other check.

I agree with you...but this is what they are telling me over the phone...DH is going to call the state Treasury Department to see if they can help, but at this point, I'm at their mercy because I can't produce the check since the state won't help me.

Yes..we have the stub, but there is no check number on the stub. Gotta love the state 
DH went and spoke to the branch manager again today...the branch manager seemed upset by what claims and customer service is telling us (his customers) and said he would call them directly on our behalf and see what he could do. All I want is for them to put the $864 back into my account and they can take the loss...I'm sure they won't miss it. UGH....this stinks!
Thanks for listening to my ranting today....you have no idea how mad I am
