Can someone tell me about this anti bullying law?

What's it's Aout, when does it go into effect?

Can you sue a parent of a child thT bullies your child?

Do schools have to have anti bullying policy??

Tell me what you know.

My nephew is bullied. He is the weakest one in the class. Both parents are dead and he lives with my mom. He is autistic/add whatever. He has no social skills so the kids are just mean and nasty to him. He is getting better and we are getting him help, but I swear I will sue every motherf*ucker in that school to get them to address bullying.

I posted this on the other thread. It goes into effect 7/1/2012. It mandates that every incident reported be documented and that schools follow through on every incident, documented in black and white.

If you google DASA anti-bullying, lots of info comes up.

The Dignity for All Students Act becomes law on July 1st.

It covers all public schools.

Private schools will be beholden to it as well if they receive any form of state aid... it would be hard to find any school that does not.

All other details are outlined in the link.

As for suing... Northport SD is currently being sued by a parent of a former high school student.

The case claims said student was a victim of repeated anti-Semitic slurs and at least one physical altercation at the hands of several bullies. The victim even wrote about it for a writing assignment in English class. The suit claims at least one teacher knew, the principal and the Supt. and nothing was done. The family since pulled the child out to attend private school.

As a teacher myself, I take bullying very seriously. My district is doing all they can. Just last week I received an e-mail from our principal after a parent called him voicing her concerns that her son was being bullied. The e-mail was sent moments after he received the call and asked us to be report anything we saw/heard to him immediately. I'm sure he sent it via e-mail so there is a record that we were told. I know the district where I work is doing all they can. Unfortunately, when it is taken to the internet and texting off of the school campus, the district has little control. At that point it's a possible police matter.

I have already attended my districts training on the Dignity for All Act and the Olweus program we are putting in place district wide to help stop bullying.


Something to keep in mind is the definition of bullying:

A person is bullied when he or she is exposed, repeatedly and over time, to negative actions on the part of one or more other persons, and he or she has difficulty defending himself or herself.

Since you mentioned that your nephew has a disorder like autism, then that would classify him as unable to defend himself.

And that's really what the problem is. He doesn't have a great capacity for what's right in social situations so the kids are just mean.

Least year the kids thought it would be funny to have him yell "I want to be a butt buddy" on the bus ie: have someone have sex in his butt. He wants to make friends so went along with it. We really don't think he knew what he was saying, just that they laughed and maybe they would be friends with him if he said what they told him.

It's a little bytes, but he just isn't main stream.

Then I really hope that the school will be on top of this now since they are now held responsible should anything happen.

Will your nephew be able to report it though?
I can be reported to a teacher by the student being bullied, a student who witnesses it or a teacher.

The other good thing I've learned is that bystanders to bullying- those kids who watch and laugh but dont actually call names- will also be held accountable for NOT trying to stop it.

That one incident got reported by the bus driver. It was a while ago.

But he just got into a fight, with a girl that's much bigger than him. She has been bullying him, finally put him in a headlock and he fought back. They both got suspended.

Kids are cruel.
