Re: POLL: I have a professional ethics dilemma...should I rat someone out?

I think I would, unless Bill was a friend of mine. It kind of sounds like he is rubbing it in, no?
Does his stealing clients directly affect you?

He doesn't seem to want to hide the situation. Depending on how friendly I was with the person- if they are part of my personal life I wouldn't say anything, but if it is just work, and I'm not working with them anymore, I think I would say something only because you said that this is something that may affect you and you're job. He was a friend, he shouldn't be taking your clients anyway.

I think he meant it to be nice. But, yes, if he steals clients, it WILL affect me...

You could mention this to your boss. But it probably won't make much of a difference.

Since he already quit... he is really free to do whatever he wants. Unless of course he signed a termination confidentiality agreement which is probably didn't.

Now if he was still an employee and was compromising client relations... different story.

I would tell your boss because what if it comes back and someone says, "Oh, but you knew!" It's always better to cover your own azz in these types of things. JMO.

I would be surprised if your bosses didn't already know. It there isn't a No Compete Contract, there really isn't anything your company can do. I would get on the phone will all my clients and make sure they are happy and getting what they need.

since "bill" quit and is no longer associated w/ the company, what is the point of telling your boss? if "bill" was stealing MY clients, i would approach him personally. if you are unable to do this, then YES tell your boss.

If he quit, I don't see what can be done by ratting him out, right?

Re: POLL: I have a professional ethics dilemma...should I rat someone out?

If he quit then he has no ties to the company unless he signed a contract or agreement with the company upon his hire and/or departure.

For example a woman was fired from my company and she had to sign a stack of papers agreeing to not return to the company or any of it's affiliates, to not contact any of our clients advising of her depature, etc...

So even though he quit he may have signed some agreement during his exit interview.

If this has a direct effect on you it may be something you will want to mention to your boss. Their is a real thin line in compliance and he could be violating terms and conditions if he signed anything upon his hire and/or departure.

There would be 2 types of agreements this is usually covered under...Confidentiality Agreement or Termination/Severance Agreement.

Since he quit, he wouldn't be entitled to severance. Are employees required to sign a Confidentiality or non-Compete agreement? (Probably within the first 2 weeks of hire?)

Yes I would tell my boss because you need to strategize on the damage he could to you and your company's finances.
