IEP timeline

Can someone tell me, legally, how long after signing an IEP do they have to start services? I signed my DD IEP last Friday and have not heard from the therapist yet to set up her scheduled visits. After reaching out to the evaluator, I’m not happy with the response and just want to know my rights.

She’s 4, so not in public school yet if that matters.

TIA! I didn’t have this problem with my DS years ago when he started services, so I feel a little blind with such crazy pushback.

I would call the person in charge of cpse in your district and ask them. I think the iep should state a start date for services. When dd was 4 we did her eval in June and they didn't start us until September. In February we did a new eval for OT and I don't think she started that until March.

Thank you! .. I don’t see a start date on the IEP. When I signed it, she told me I would hear within a week from the speech pathologist, but at the week mark when I emailed, since I heard nothing, she started giving me the run around.

She had the eval done in December, but they couldn’t fit me in to sign the IEP until March 9th. I find the whole process ridiculous that it takes 60 days to sign a piece of paper, but I’m hoping they will finally start her soon.

Woah that is crazy that the time line I think. My son, also CPSE, services started pretty fast. You should have a copy of the IEP. The start date should be on the front page. I work in special education in the city and I have to say that I think it is easy for parents to be taken advantage of during the process if you don't know all your rights.

When you say sign the IEP, you mean when had the initial meeting? The timeline should be something like your child had the evals, they were completed, you got notice of initial meeting, initial meeting was held at the district office, decision was made at initial meeting what services and frequency of service your child qualified for, IEP should be drawn up at the meeting, you should be notified of the IEP start date.

I would also call up your CPSE director at your school district. You should have a copy of the IEP in your hands as well. You could also call agencies your self to find a speech pathologist.

The IEP, once created, should be started as soon as possible but no later than 30 calendar days after it was determined that the child qualified for special education services. A copy of the IEP needs to be sent to the parent within 21 school days of when the IEP was developed

I do have the copy of the IEP, I received it on March 9th. I did notice the start date is March 9th, and I’ll be fighting for the end date to be pushed out until her actual first visit.

I do think we were taken advantage of. With my DS, I had to push back a lot but now it’s at the point where they give us everything we ask for, so it was stupid for me to send my DH to sign these forms without me there bc he has only seen the easy meetings. I won’t let that happen again.

But the timeline was

Called 10/15- got appt for dec 14th for eval
12/14- eval, we were then told she qualified but she didn’t have an opening to sign any paperwork till March 9th
March 9th- signed papers to start IEP

Now I’m being bullied bc they want her to be in a group setting and I’m against it, and they apparently don’t have enough pathogists to cover her 1x a week for 1 hr, which is not my problem considering I already have the IEP signed for 1v1. She wasn’t even answering my calls today, so I emailed her to let her know I’ve hired an advocate and she will be hearing from her from now on. Hopefully the advocate will be able to get the ball rolling, and in the meantime I’m paying my DS speech pathologist on the side to help, but she works for the school district so technically is not allowed to moonlight after school.

And thank you to OP for confirming the 30 days. I can’t believe they can prolong this so long, but at least we have some options. I’m going to see if I can get private sessions through my insurance too.

Did they agree to summer too? I would push for that just bc it's so close to the end of the year already. When dd got ot it was March and she was heading kindergarten in September so they gave us summer session just bc it was so late in the game. I'm guessing you have another year of preschool but iut could be worth trying for anyway.

Yes they agreed to summer bc she’s not going to kindergarten, she automatically goes on a full year calendar instead of the school calendar. So that worked in our favor.
