Serving Finalized Divorce Papers Question

A female relative just received her final papers that finalize her divorce. She has to have them served to her ex. According to the rules, she cannot do it, but anyone else who is a NY resident, over 18, etc....can.

She wanted to hire someone to do it, but her ex does not answer the door, just goes to work (questionable if they would allow a strange person in the building), and he LITERALLY does nothing so there is nowhere she can have the person meet him publicly.

So my question......could her brother-in-law serve the papers? Specifically, to her ex in their home (they both still own the house).

She lives in Suffolk if that matters.

It doesn't sound like she has the finalized papers, it sounds like she serving him to start the divorce proceedings. Or maybe this is the final copy he is signing based on what they agreed upon.
Anyone over the age of 18 can do it.
As for when the decree is issued, they can each go and get a copy from the court, you are not required to notify the other party.

A process server can do a nail and mail.

I agree with you on the first part, but not the second. My decree had to be served on my ex husband within 20 days of it being entered.

To the OP, I would call a process server to have it done the way the court wants it. You can also call the sheriff as well. It'll probably run her about $75-$125

Well they were the finalized papers and she had her brother in law serve him this morning. One more step and she will be free!
