Loosing my job - update at top

My boss is an A hole.

I had a bad review. She NEVER stood up for me. I want to be clear. I own the mistakes I made, however most of them were extenuating circumstances and she never came to me and said "hey what's going on".

I have been given the option of a performance plan (PIP) or stay for a little bit and then they will pay me for 2 months so I can find another job.

I asked for 4.

I have to make my decision tomorrow.

I cant stay. I cant do the PIP. She is out to get me and get rid of me. The PIP is worded in one part:

• Work product produced error free. Proofread all work before sharing with others.

So she CAN fire me if I were to write an email with a misspelled word. The PIP is designed so that she CAN fire me for any little thing she deems "unacceptable".

Now the spirit of this sentence is to make sure I pay attention to detail. I get that. But it also gives her a very large latitude to fire me at her whim.

I also feel that if she wanted me to stay she would have called me and said "look, I want you to stay. We are going to work on this and get you where you need to be". But nothing.

I was talking to HR about it yesterday. HR said my boss was unhappy I was leaning on a former co worker to help me set up a space. I said to HR (get this)

"Boss TOLD me to CALL former co worker to help with the project".

UGH. This flucking sucks.

Update:
So I asked for 4 months. HR came back to me and said she spoke to TPTB. They said standard was 2 and in fact this is the same pCkage they give attorneys. There was never a question about my work ethic, team spirit etc etc. so they are offering me what they give attorneys.

So I essentially get 3 months. And then I hVe 5 weeks of PTO.

I stay through the end of April. After that I get a payout lump of my PTO (5 weeks).

After that I get to stay on the payroll for 2 more months. This is good because I don't have to pay massive taxes on this lum sum. I'm fine with it.

And we are good financially and my DH carries the insurance. So I can decided to go into business for myself or look for another job in the industry, or something else.

This is what I was thinking. It sounds like this boss is toxic to work for anyway... I wouldn't want to deal with constantly having to worry if I made an error.

On the flip side of what everyone else is advising, if you can get them to give you 3-4 mo salary, it might be better to take that option if you think you would be able to find a new job in that time, since then you wouldn't have to say you were fired. you should also try to negotiate a positive reference, or at least a neutral one.

I'm sorry. Regardless of whether or not your boss is toxic, it's hard to lose your job, especially after a crummy review.

I do agree with PP though - start looking for something else and let them fire you. You don't need the stress of working for such a vile person anyway.

I would ask for 4 months to look for a new job. The pip is basically their way of saying we are firing you regardless of this plan. I'm sorry.

You would be able to collect unemployment at the end of the 2-4 months because they will probably word it as a layoff

I thought if they lay you off you can collect unemployment but if they fire you then you cannot (although not sure what the difference is)

If you lose a job (fired or laid off) you can usually collect unemployment. If you have severance, you can not collect until the severance runs out.
There are some offenses that can get you fired that preclude you from unemployment.
If you leave voluntarily, in most cases, you can not collect. If you resign in lieu of termination (and can prove it) you can usually collect.

OP: See what kind of severance you can get, take it and let them let you go.

This - if they will agree to 4 months I would take that option and if you don't have a new job by the end of that time, you can collect unemployment. Sorry you are going through this. I'm sure in the long run you will be better off in job that suits you better

kinda agree with this, but pp are correct you cant collect unemployment until you severance runs out

Just on another note, I was "fired" in the past.

It was the best thing that ever happened to me. I remember coming home crying, miserable. My husband kept telling me to quit but I wouldn't. My boss was giving me impossible deadlines (i.e, giving me a 10 am deadline at 5 pm etc, telling me to do things/not do things and then get upset etc)

I have an amazing job now, and I probably never would have found it.

Don't let it get you down. At first I was almost depressed, I felt like I failed - even though I knew I didn't.

my company filing for chapter 11 last year was the best thing that could have happened to me, without I would still be that ****** job. I too was not willing to leave because I liked my co-workers .

it gave me the kick in the ass I needed

Move on.

My manager asked me to violate corporate policy yesterday for the second time. My husband says print out the emails when I go in to negotiate. It happened yesterday so it's not like I'm bringing something up to be an a hole. He said use that as leverage for a few months.

Getting laid off and having 4 months is better than unemployment. I anticipate I will ABSOLUTLY have a job in a few weeks. So the 2/4 months is attractive. It should not get to unemployment. I hope.

Any opinions about this?

I don't think there is any reason not to take the severance, especially if you think you can have a new job quickly. If they don't offer you more time maybe you can negotiate a positive reference.

I haven't read any of the above, but...

What you have to do is take the 2 (or 4) months. Before you sign anything, you need to get a few things in the separation paperwork:

1. Confirmation that they will not contest your request for unemployment.

2. That they will not disclose the terms under which you left to future employers.

I would go to the HR person and tell them you want 4 months of severance (including paid COBRA if you have coverage). You are prepared to sign a release to waive your rights in any claims against the company. You want your termination to be immediate upon the signed separation agreement.

There was no gross misconduct.

I spoke with my sister in law this morning. She gave me GREAT advice. Said ignore the corporate policy stuff. It makes me look petty EVEN if its true. Plus it has the real and seriously potential of burning the bridge. I do want to make a graceful exit.

What I am going to tell them is this " I am considering both options seriously. I need to know that I have the approval for 4 months before making my decision.

That TELLS them "give me 4 months and I'm gone".

I assume they will have me sign something about non disparagement and that I wont sue and that (possibly??) I wont file for unemployment. Unemployment makes no diff to me. My husband carries our insurance and with my skill I will find a job relatively quickly. (knock on wood).

So it should not get to any point where I am collecting unemployment. (knock on wood).

And loosing my job does put a financial strain on us, but we wont loose our house or anything. So This is more of a stress of just loosing my job, not that I will be on the street.

Good advice. They can't make make you give up unemployment benefits. I wouldn't mention it or bring it up. Then after you leave just file.
