Maternity DOE

I'm due in the middle/end of August before we go back to work. Please explain the maternity leave for the NYC DOE. I have over 50 days to use in my CAR.

Congrats! You should probably reach out to HR in later January. Things are changing because the mayor is rolling out 6 weeks of paid maternity and paternity leave to city workers. They are still ironing out all the details and negotiating with the unions.

However, to my knowledge I believe that you won't have to use your saved days for the first 6 weeks :)

Right now it's only for non union city employees. I'm not sure if they are negotiating with the UFT yet.

You are right that's why I said reach out later in January. My understanding is that they are working on it...

what!!!!? No way! How would 6 weeks paid maternity work if you are due mid-summer? Kind of stinks that you're already off and would not be able to take part in the paid leave. I would imagine they would have to allow teachers due in the summer to start the 6 weeks paid come September

ETA: I'm due July 21, and my 6 weeks would be over by labor day

JMO but I wouldn't bank on policies changing. The DOE is too big, and frankly it would cost the city a fortune. I hope it does change, but I don't see it.

As it stands now, you can take 6w (8w for a csection), FMLA leave which is 12w, or take the rest of the school year.

You only get paid during the 6/8 week recovery period. And you only get paid for that period if you have the days to cover it, which you do. You don't use the days from your CAR on non-school days (weekends, holidays, vacations, etc). The time still counts though- so a 6/8 week sick leave starts at birth, not the first day of school. Your health insurance will cover you for a total of 12 weeks, running concurrently with the 6/8 week recovery period.

I just had my second child August 16. My maternity leave started the day he was born but my days didn't start being used until September 9. After the six weeks was up I stopped getting paid. I had plenty of days in my bank but they don't let you use them to extend your leave. I stayed out a total of three months but didn't get paid through most of it. Then I had issues when I came back on payroll. Hopefully you have a good payroll secretary. Good luck. PM if you have any further questions.

So let's say you give birth August 1st. Could you start FMLA in September? I know you wouldn't get paid but for secured time off.

Yes, FMLA does not kick in until the first day of school for teachers in September. So my FMLA didn't start until September 8 which is why I was able to stay out until the end of November.

You get 6 weeks for vag birth 8 weeks for section. But 12 weeks total you also get a 30 day grace period to keep benefits and can borrow up to 20 days in addition to what is in your bank.

So, say I give birth August 15 and the first day of school begins September 1. I could use 50 CAR days starting on September 1 and get my regular pay checks. Then, return back after I have exhausted my 50 CAR days let's say around the end of November. Is this correct?

as long as you don't exceed the 12 weeks for fmla. If you are going to take more time than the 12 fmla you need approval from your doctor for restoration of health leave where you can use the remainder of your days and borrow up to 20

so lets say school starts on Sept 1 you take 12 weeks fmla until 12/1 using all your sick. if you have 50 but need 60 you can use your 50 then borrow 10. You can then if necessary take unpaid restoration of health leave but before that kicks in you can take a 30 day grace period where you get paid for holidays and weekends. so if a doctor wrote you out for the month of December until January 2 you would be on grace period which enables you to keep your benefits and get paid for holidays and weekends.

Sort of. You only get paid during the first 6/8 weeks after birth. That's it. FMLA allows you to keep your job and your health benefits, but has nothing to do with payroll.

I'm confused. If my FMLA ends in October but I have CAR days left to use. Could I still stay out until I exhaust all my CAR days in November and get paid?

Exactly. Once the 6/8 week period ends, you're not considered sick, and can't use any more sick days from your CAR.

The only exception to this is if you're legitimately sick after that point and a dr. will vouch for your condition.

I've been meaning to come on here and keep forgetting. The maternity/paternity leave on the admin side passed. Basically you get 6 weeks and can use it any way you want during the first 120 days post baby - first 6 weeks or second 6 weeks or you can use a couple days each week. For example if you wanted to use sick days for the first 6 weeks and then return to work two days a week and use the maternity time 3 days a week you can do that as well. You cannot use the time after 120 days. I'm really curious to see how negotiations with the uft turn out. I work in the central offices but I'm a union employee so I'm interested to know. Hopefully they work something out quick (rumor is they will) AND I get pregnant (God willing!)

that sounds great! it's nice to know that I could use the 6 weeks come sept even though baby will be 6 weeks old on the first day of school. I truly hope this all passes for UFT. A friend of mine is due next month and was at a maternity workshop for the UFT- she heard that they haven't even begun the negotiations for the leave yet :( they told her it won't happen for her in time, and may not happen until next year

If you have the baby august 15 and have natura birth

8/15-8/21week1
8/22-828 week2
8/29-9/4 week3
Once u hit first day of school you will have about 3 weeks left of you 6 weeks and you can get paid for those and use car days

Then i believe you will have 9 weeks of fmla (fmla started first day of school) and you can stay out for 9 weeks but will not get paid

would like to update everyone on the 6 weeks paid leave- I spoke to someone in the UFT and asked for an update/if it would be unrealistic to hope it would be settled by September. I was told that they are extremely confident that it will be settled before September, but that the terms of the leave will be different than what is out there now. Right now (for non-union), you are granted 6 weeks paid and can choose any 6 weeks within 12 weeks after birth to be paid. Meaning, if you gave birth in July/August, you can use to begin your 6 weeks paid on the first day of school..

However, I am being told that we may not be granted that same "luxury", and might be 6 weeks paid immediately after birth, which wouldn't help those of us due in the summer and getting paid already. They said they are not 100% sure what the negoations will be yet, but to keep that in mind.

I was also told that we will be "giving something up" in order to be granted the 6 weeks paid. The current discussion is that all teachers will give up 1 car day, and only be granted 9 instead of 10
