Who gets your children?

We are getting more Life Insurance and you have to put a secondary beneficary.

We have Life Insurance from before kids and on my DH's it is me, then his sister. On mine it is my DH, then my Dad.

On the additional life insurance we are doing the samething.

My brother and SIL are first in line. After them it's my best friend and her soon to be DH.

We just finished our Wills with our lawyer and increased our life insurance. 1st in Line is my sister, 2nd is my mother and 3rd (since we all travel together) is a cousin.

My parents. DH's parents are 2nd (my parents are about 10 years younger than DH's parents), my cousins would probably be 3rd. It may change since we both have siblings, but DH's sisters have a LOT of growing up to do, one of my brothers has Autism, and my brother's wife is overwhelmed with just my nephew (who is not a difficult kid).

BIL is first in line. He is still young but very responsible. We would want him to raise our kids.

On both of ours, its one another first and my sister is secondary on both of ours bc if we are gone, she gets the kids.

We just did our wills and put the older of my sisters as first in line, and my youngest sister as 2nd in line and then BIL.

For our life insurance we out each other and then we are referencing the family trust which will go to our kids. Our lawyer recommended this and said not to put others as beneficiaries on any policies as it would make things hairy.

nothing in writing. But probably his mother since I loathe my step mother and would not want my child subject to her.

Honestly though my aunt is pretty much her grandma by default and would be the best choice but she's 72! (haha i thought she was already 72. I was wrong this Feb she hit that age).

my brother doesnt care for his own child, no way I'd give him mine. My sister stopped talking to me for something childish and unknown to me so she can't have my duaghter, his brother is just married and still not settled, his sister is even younger and still having a good life. His family is all the way in NY and my father's health would be questionable.

So right now..? Auntie. If she passed on then maybe his mother.

We finalized our will and living will a few days before DS 2 was born.

First in line is DH's cousin, followed by one of DH's best friends.

It's hard, we are both only children and it was so tough to figure out who to choose.

We have nothing in writing and SO NEED to do this.

However, we both agree that my sister would get custody of DS should GOD forbid anything happen to both of us.

My brother and SIL would be next in line.

If SIL (DH's only sibiling) didn't live across the country, her and BIL would have been our second choice.

Although, I still prefer my brother and SIL - DS knows them. He has only met SIL & BIL twice because of the distance.

My SIL who has no children has offered to raise all 4, heaven forbid something happen. Also my BF and her DH have offered.
So its my younger Sil then my bf in our wills.

My brother is the one we asked if something were to happen to us, he would get DS.

Dh's sister/brother in law live in OHIO now..always moving for jobs or whatever whim strikes their fancy.

My brother is a little more grounded, almost same age as SIL/BIL, good job, etc. and he lives close to both grandparents so he would have them as a support system. And I can be assured there wouldnt be any sort of custody battle involved. We've informed our parents of our decision as well so everyone is on the same page.

This reminds me I need to get this written up legally as we were just discussing this a few weeks ago.

does this legally need to be listed in a will? as far as who gets the kids?
How much does a will cost, you do it with your personal lawyer?

We created wills she our DS was born. My sister and BIL would be first, then his sister and brother in law. Our money and assets would go into a trust, my sister being the trustee and if God forbid something happened to her, the DHs best friend. The money can only be used for the kids needs and care taking, and then they would get a percentage at different intervals during their life(lol - I think there is money that they would get up until they are 40).

If God forbid something happened to my DH and two kids, then funds would be separated between our nieces and nephews for them to get when they are 25.

Yeah, we over thought it but DH was a financial planner.

My aunt and uncle. My brother has 3 kids already, his brother lives way to far from my mom, and that would just kill her. Our mothers are in their early 60's and done with kids. My aunt and uncle have 4 kids, but used to the daily grind of it.

it will go into an estate 1st if there is no guardian.

First choice will be my parents as long as they are willing and able to.

We have not decided on who is next line. I do have a long list who no matter what cant have them . Chat Icon

I did a full will/health care proxy etc last week. I used Legal zoom but then was told it can have issues being held up in court. I decided to just go meet with a Lawyer. My DH has a few antique cars and wanted provisions set for them (as far as storage until DS is 25 etc) . It cost $1200 and it was worth much more because I finally have piece of mind.

My sister and BIL (and their 4 kids, LOL). We don't have anything in writing but there is no one to fight over her/the life insurance so not too concerned about it. My parents are also in the picture but just makes sense for my sister to take the baby but if my parents took her I'd be fine with that too. She'd be loved and well cared for either way!!

It is very good to have things in writing and stuff buttoned up...it will limit the amount of time spent in probate court which costs $$$ and time. Also there will be no family altercations or issues as to who gets the kids, etc. Overall we did it for piece of mind and to help make things clear and easy if godforbid anything happened to us.

I heard a horror story of someone's grandfather who has no will or trust set up and his estate (which was millions) was tied up for YEARS. After legal fees and etc the family was not left with much. I don't know the whole story but it was enough to scare me and we got ours squared away. I would hate for my sister (the guardian) to have to deal with a nightmare of sorts while dealing with a death and trying to care for my children. It is expensive but worth it if you ask me!

I am an attorney and a mom of three and the previous posters are correct having guardianship spelled out is a must! I'd say as parents that's even more important than the will! Because most everything we possess passes automatically by operation of law (bank accounts, etc) but not custody. I am always happy when I see these discussions on LIF because it conveys the importance of having it done.

Feel free to fm me if any of you need help finding an attorney who can draft will documents for you. I know for some people cost is an issue but keep in mind thereby be something you can work out. I just read an interesting article in my parents magazine about swapping and trading services or goods which I personally have never explored but maybe should. I am working from home so my salary is not what it used to be. We don't use professional photographers right now or have a landscaper or housekeeper or nanny, etc. It might be that you could negotiate a trade with a professional for services. Just a thought.
