Had a car accident tonight - what do I do about the car seat? (and for the nine hundreth time car seat reccomendation).

Coming back from open school night, DH and I got into a car accident. The car is pretty bad off but we are both ok (and DS was thankfully home sleeping). I am going to try and get all my ducks in a row tomorrow but I do not know how it works with the carseat? Do they giave me the replacement value for the same model? I have the Radian Sunshine one (that I LOVE) but I think it is called something else now?

When we were in an accident I called my insurance for a replacement seat and they said you don't need to replace it if you could drive your car away from the accident.

That's crap!! I'm sorry!! I would not trust that what so ever and would have kept fighting for a new seat.

The stress and strain from an accident whether a child is in the seat or not can cause the integrity of the plastics to weaken as well as the frame that is metal. It specifically states in my users manual NOT to use the seat after an accident in case of unseen damage.

OP- I would make sure that my insurance company as well as the other persons insurance company were well aware that there was a car seat in the car and that you have intentions on replacing it ASAP because of damage it could have incurred from the accident. Ask what their policy is for reinbursement and take it from there.

A friend of mine was in a minor accident with 2 seats in the car and she was able to be reimbursed for about 75% of her new seats.

Glad that you both are OK.

Diono (formerly Sunshine Kids) requires replacement after any crash, they do not differentiate between occupied and unoccupied. Seats still sustain crash forces and absorb energy from the crash. They're a one time use item.

EDIT: To my knowledge, the only major manufacturer to follow the NHTSA guidelines for replacement is Britax. All other major manufacturers (Diono, Graco, Evenflo, Safety 1st etc) all require replacement after ANY crash.

You should be reimbursed for REPLACEMENT costs, not a percentage based on years owned etc. You may have to fight on this. If the accident was your fault, you're likely going to have to pay for the seat out of your own pocket, unfortunately.

there are car seat replacement guidelines. sounds like since you couldnt even drive the car your insurance wouldnt give you a hard time replacing it.
i was rear ended with my daughter in the car-thank God for the car seat-it protected her...if only we all could drive around in them. the insurance of the man who hit me sent me a check after i sent a receipt of the new car seat.


i reread what you wrote and your son wasnt in the car so im not too sure how that works..sorry its 6am
glad you are ok.
just take it easy-you may start feeling bad after.

The most important thing is that you and your DH are ok! You two are NOT replacable!!! :)

I would think the insurance company would take care of it.

Please replace car seats! My DH and I were rearended twice in 2009 and while they were small accidents, the undersides of the carseats when we replaced them had white pulls in the plastic. I hadn't realized insurance would pay for new carseats, guess its too late for me now lol. And I have the sunshine kids carseats too! Love them!

I don't know what the rules are, per se with the NTSB, but I would replace any car seat that was in an accident. Occupied or not.

I was rear ended it was not bad. But the cop ( a dad) said to go the nearest store & buy a new carseat right then. I had called my insurance company from the accident & they told me to fax in the receipt for the new seat. I was mailed a check for 100% of the new seat right away. This was handled entirely separate from the repairs to my car and was done much faster.

Most personal auto policies have a small limit, (under your collision coverage) which will reimburse you for PERSONAL property damaged in the accident. Usually between $200-300 per accident. Get your policy and read it over.

yeah it all depends on the policy and your insurance. My car seat can be covered under my homeowners. But there is a small allowance under my auto policy for peronsal property. If I was not at fault tho, everything would go through the other guy and yes, I'd get a new car seat.

Irony is I paid $99 (plus $5 shipping) for my carseat. It is however a Recaro and is much much more expensive. I would get Replacement cost to the same like kind and quality. Given that it is a car seat no depreciation should be applied.

Anything other than that, and I'd fight it tooth and nail!Chat Icon

..... then again... my insurance company knows what I do for a living LOL and I have already reported them once to the State of NY for the Fair Claims Act violiation. Chat Icon

This only applies you are at fault

If you are NOT at fault you should be reimbursed by the at fault driver's coverage and push for the full replacement value

ETA: Xelyndria's post pretty much covers it all.... there should be no depreciation and you can also use the argument that it is permanently installed via the LATCH system/seatbelt.

A few months ago my sister rear ended another car. Her car was totaled. My DD's car seat was in the back. DD was not in the car. She called Allstate, which was her insurance carrier, told them the seat was in the car. They said to buy the same car seat and we brought the old seat along with the receipt for the new one to theirs claims office. They gave us a check for the entire amount. Best wishes!
