Maternity leave Agreement/No FMLA

Hello All,

I am currently a FTWM and my company has less than 50 employees, so we don't have FMLA. So I am very concerned about keeping my job and I am due in April w/ DC2.

So, can anyone share their Maternity Leave Agreement that you have used or plan to use? or any past experiences?

I wanted to consider also working from home a few weeks after the baby is born, because I don't know how I will be able to afford not to work as well as show my company that I am a dedicated employee.

Any thoughts & advice are welcomed.
TIA.

Erica

I did some research into this as my job isn't under FMLA either. Technically they have to give you the same amount of time as they have given other employees in the past who have gone out on disability. I was scared, but when I told them, they said I could take the 12 weeks anyway. Maybe the same will work out for you.

Ok thanks I'm the only one to go on maternity leave in the company. So I'm like the guinea pig. Do you have any intentions of working from home?

No it can be for any type of disability. So if someone got 8 weeks for a knee replacement that would count too.

check this out.

Unfortunately my firm will not allow me to work from home. While it isn't ideal, it isn't terrible.

i had no FMLA and i got totally screwed. i got my 8w as per short term disability (had a csection). i got 3 weeks paid per my employer and the rest paid per my STD policy.
well after 8w i asked to work from home just 2 days a week cause i wasnt MEDICALLY cleared to go back - and was able to claim short term disability for the entire 6m post partum (i had an insanely traumatic and rough birth of a preemie at 33w). my doctors even called my bosses several times. well i ended up with a severance package since i couldnt return. they wouldnt even consider letting me work from home. it was a nightmare...not being covered by FMLA is horrendous and this country's maternity rules are ridiculously pathetic. i hope you fair better than i did.
