I was fired while on medical leave
I need some guidance. I was just fired while being out on medical leave that my boss agreed to. I am not eligible for FMLA. I work in an office for a real estate agent, so she does not qualify as an employer. It doesn't seem legal that she can fire me, besides being morally wrong. Would love to get some feedback

i was fired while on bedrest for this pregnancy too....i'm currently on unemployment, but yes it's not exactly legal

reach out to your local labor dept. they will guide you and see if there is something fishy.

Did they give you a reason or explanation for firing you?
I only say this because a girl in my dept at work was fired while on maternity leave, because her being out for 3 months uncovered some MAJOR mistakes that she had been covering up. I'm not saying this is the case for you, but in her case I think it was justified.

Unfortunately i believe it is completely legal. NY is a right to work state and every employer can fire someone without a reason. And in your case you would only be illegal if you were covered under FMLA.
But i definately agree that it is a morally bad decision

Having just been through this I can actually both confirm and disconfirm parts of this. . bosses do not need to give any reason that is justifiable for why they let you go. . a lawyer told me that if they are doing lay offs they can say we are firing everyone with 5-6 letters in their name and that is legitimate BUT and this is a big BUT . . if you can prove that it had something to do with being on medical leave, being pregnant or any type of disability it is completely illegal and you do have recourses. . this is what happened to me. . I am happy to tell you more about what went on with me but can't really do it in a public forum but feel free to FM me and I can say more. .
