Im livid...
We had our roof done - came out great. Now on to the siding. The contractor pulls off the old siding which was being replaced pretty much because we wanted to start fresh not knowing what we would find underneath. Well we found something...OLD termite damage. Great. I know its a common LI issue and we have no choice but to fix it, it just sucks. I also think we have little if any recourse with the inspector since this was not able to be seen until the siding was pulled:
I dont even want to think what could be on the inside and if there is damage, I cant do anything now. Ive got one baby on a nebulizer. Grrrrr.

Did you get a termite inspection? How was your basement? Is it a finished basement?
Termite damage is extremely common on LI. Very common. And when you pull off old siding you have no clue what is going to be under there and neither would an inspector.
So the question is what could be seen inside that the inspector was supposed to look at?

We do have a finished basement. It also has old termite damage which we knew about. We also had an inspection. DH will be discussing this with our RE attorney.

From what I can recall, termite inspections have to be done often, at least in the home buying process. Our closing dragged on and I remember we had to get a SECOND termite inspection done before finally closing, and I was shocked....it felt like we just had one done!
i hope you do have some recourse though..I would imagine this to be very frustrating (although very common)

My sister, who happens to be an attorney, said that since he knew we already had old (though treated) damage in the basement, that we MIGHT have SOME recourse in terms of inspector malpractice. I'm hoping our RE atty can shed some light on this. I'm not terribly hopeful. Buyers beware.

ITA. The home inspector has no way of seeing underneath the siding so he can't be at fault.
My inspector told us, "there are two types of homes on LI--ones that have corrected termite damage and ones that WILL if they don't yet." Did the prior homeowners have a contract? Have you kept up with that contract?

All inspections and termite contracts state that the inspector can only spot VISIBLE termite damage.
There is no way for them to look underneath siding. So there really is no case here.
Is replacing the sheathing really that much? It's just lumber. Rip off the old and nail on the new.

We didn't get an estimate for the repair. I know in my heart that any attempt at recovering $$$ will be futile. I'm pretty much venting. We are SOOL but we are fortunate that we can take care of it. It may prolong the bathroom and basement overhaul, but it will get done eventually. This is why we did not sink every last dollar we had into a down payment leaving us with nothing. Thanks everyone.

Welcome to LI. When we pulled off our siding we were able to put our hand through the wall under one of our windows. Thank god the siding guy replaced the wood and the termite damaged windows for almost nothing

Yeah it does suck. Sorry you had to deal with that.
Yeah, we actually had $52,000 worth of structural damage to our home(not termites) that we discovered a few weeks after moving into our 1st home. Our issues WERE VISABLE(this was key). IN the end, our inspector was a scam artist and had no insurance, so we could never collect our money. Criminally we was in trouble but we were S.O.L.
We also spent $5,000 in legal fees and about another $5,000 for a PE to document the damage and repair(this included all documents, blueprints etc)
ETA: this inspector came highly recommended by 4-5 people. But obviously the loved hime because they bought houses that had little to no issues.
LESSON TO BE LEARNED: I will never hire another Home Inspector, I will spend the extra $ on a PE
Backround check anyone you hire, even if it is a referral
