Frustration!

So we are just waiting on our closing date for our house. The on or about date in the contract is Dec. 20. The current owners requested that they be able to stay in the house for Christmas but said they would move out with enough time for us to move in by January 1. We understood and were very accomodating (with this and MANY other issues.) This was the plan from the very first day we had an accepted offer. We went through our entire mortgage process and checked in along the way. Still the same plan was in place. Our attorney kept contacting them about when the closing date would be etc. THey did not get back to us. We were afraid to lock on our mortgage rate when it was SUPER low out of fear that 30 days wouldnt be enough time.

We are renting out our current condo and lost out on 2 tenants because they couldnt give us an answer. We find one that wants to move in on Jan 1 and he is GREAT so we sign the lease since their plans were fitting perfectly with ours and the tenants.

We finally lock because rates kept increasing and they tell us they might not be able to move out so that we can be in by Jan 1! So now we might have no house of 1/1/11 because these people can't get their act together~ I just want to cry!

The attorneys keep saying we have plenty of time but 3 weeks for us to find somewhere to live (with 2 huge bulldogs) is not good! I feel like these people need to do what's right and get out since THEY and THEIR agent told us on numerous occassions that this was the plans. It's bad enough that we will be paying 170 dollars more a month in mortgage payments than we needed to because they stink!

Sorry for the rant but I am just at the end of my rope! Any advice??

I don't have any advice other than to hang in there! I'm in a really similar situation. We were supposed to close by 11/20, but due to circumstances that aren't even partially our fault, it got pushed back to 12/20. Problem is, we had told our landlord we would be out by 12/1. We're now living in a studio apartment in my cousin's house with our dog and it's awful. I wanted nothing more than to be in the house by Christmas, and it just keeps getting delayed. We've been waiting two weeks on the survey, our attorney keeps PROMISING that she'll have it and then pushing it back a couple more days. I'm terrified and sooo grumpy being here, not to mention incredibly stressed from the entire process.

I wish I had advice, but I just wanted to let you know that you're not alone in this frustration!

I am sorry you are going through all of this! It is soooo hard to coordinate buying and selling/renting. We are in a similar boat except everyone is ready and we are waiting on the bank. They say oh youll hear by this week then change it to next week. I just want to know when we are closing already!!!! I am 29 weeks pregnant with twins and I NEED to get in my house. We live in a studio now!

Lauren - Im so sorry about all of this. Just so you know i believe even though you have a closing date of Dec 20th technically they or you could have an extra 30days beyond if need be. If they are in fact in the house in Jan. they will be paying the mortgage, any bills that are incurred to the home & if anything is broken or breaks they will be responsible to have fixed before you move in. Also if you do close & they cant get out they would then have to pay you rent for each day they are in the house. As for you. Anyway you could stay with family so new tenant can move in on time???

So house closings can drag out. I would have your atty push the bank atty to set the closing date.....the bank atty is the own that really picks the date and then the seller and buyer attys say if they can make it and then rearrage the date from there. Then after closing the seller can still stay in the house for a few days.

Not sure if you knew all of this going in but closing on a house is the worst process ever!!!!!!

Yeah we realized that they did have the the time legally but all along EVERY party has been saying this was the plan. They are still saying closing should be before the first of the year but giving us possession is another story. Ugh.

The issue with staying with family is that my parents are divorcing (and still living together...not good lol) and DHs parents aren't keen on the idea of us moving in with our two dogs. Not such an easy situation...hoping it won't get to that point! Chat Icon

I hope everything works out for you! We were just informed that our sellers (the house is empty, it's an estate sale) want to close on December 22nd. Seriously?? 3 days before Christmas? Apparently their attorneys are all "busy this entire week"

I know the feeling... When we bought our house our original closing date was 11/20/08.

...we closed on 3/3/09 (at 8:00 at night).

Now, our situation was created when the seller passed away one week before the original closing date and then every other complication possible happened.

We had to keep asking our landlord to let us stay and she was fine with that - until she found a new tenant. Fortunately the first one fell through otherwise we would have had nowhere to live for a few months. In the end we had to be out of our apartment by 3/8 AND couldn't take any time off work in those days so needless to say there were several late nights of ripping up carpeting and painting and packing...

But, in the end it was all worth it. Our crazy, insane experience to own our house that I thought would be the death of us now is a funny story to tell.
