Very little in the OP makes sense. I don't see why it should make a difference if the OP posted under her "real" LIF Name. It wouldn't change my opinion of what I've read, and I don't really see why it would change anyone else's...

That said, while parole can vary from person to person, the terms of one's parole are generally crystal clear, and the rules as to what is legal / not legal for a parolee (or former convicted felon) to do / own / possess are also pretty clear.If you think there is a grey area, then it's up to the parolee to find out if something does or does not violate the terms of his parole. Obviously you thought there was a potential problem since, according to the OP, you asked whether what you did was okay to do. If he thought it could be a problem, he should have checked with his parole officer. YOU cannot violate someone else's parole. Unless nothing was actually done wrong, then either HE violated his parole or you used his name illegally, causing the authorities to think he violated his parole.

Also, you say there was a warrant issued for his arrest and he was arrested... but then you say he cannot get a lawyer. That makes no sense. If he was arrested and charged with a parole violation, he (like everyone else accused of a crime) is entitled to a lawyer if he wants one. If he cannot afford one, he is entitled to a court-appointed lawyer.

I'm sorry you are going through this and sorry you are feeling guilty... However, it was your friend's obligation to meet the terms of his parole - he is responsible for that, not you.

to be clear, i was not referring to those who were confused (as i stated, i was confused as well). i was referring to those posters who were less than considerate with their comments towards the OP. whether it is true or not (and i agree that her friend was responsible for being on top of his conditions of parole and not the OP), she feels responsible and she feels bad, and it seems that others were trying to be snarky or make her feel worse - and i truly believe that there would be fewer snarky comments if this person were not in hiding.

Im so sorry that you are feeling guilty and like this is your fault. Maybe is you could give us all a little more info as to what you used his name for, we would be able to give you better advice. regardless of the scenario, Kara is (as usual) totally on point.

your friend is entitled to in the very least a court appointed attorney.

the attorney can argue that whatever violation your friend was accused of was not spelled out in his papers and was not known to him. you could aid in his defense.

I understand feeling guilty, but there IS something that can be done. even if your friend loses, at least you can try. Chat Icon Chat Icon

Correct. This sure is one bazaare post, but all of the strangeness aside- if your friend cannot afford an attorney he is entitled to a court appointed one. Frankly, whether it truly is a gray area or not, it would be foolish at this point to turn down any assistance from an attorney. It's not like he has anything to lose.

Like others, I'm confused but feel for you.

Since you did this thing under his name, can't you tell that to a lawyer? Isn't it forgery? If someone forged his name, etc, why would it be a violation of his parole?

So what was done, must've been borederlien illegal. Like using someone information to work or healthcare etc... I am sorry that your friend has to go to jail and that you were involved in why he is going back there. I would also feel guilty and like crap if I was you. If there is absolutely no way you can help him beat this than the only thing you can do is be supportive. Maybe he will be releases early?? Wish you both the bestChat Icon Chat Icon

With 1000000000% certainty, NOTHING ILLEGAL WAS DONE.

This entire thing is really a misunderstanding of a technicality.

The OP doesn't want to give all the details out and such, really they were just posting because they were upset and venting about it.

No the OP did not use their friend's name in an illegal fashion, they did not do anything to break the law, they did not use or forge their friend's name or do ANYTHING SHADY. The OP and their friend just didn't run something past the PO, and assumed it was okay, and it turned out it wasn't, and the parole board considered it a violation, even though they didn't think it would be a problem. That's it.

I'm sure this might confuse people more, but I just figured if you heard from someone else that no it was NOT illegal, it might help people a little bit.

Sorry if I'm not giving details -- but just trying to abide by the OP's wishes.

I just wanted to let people know who keep saying

"Well you must have done something shady" or "Well obviously you did something illegal in your friend's name" or "Yeah you must have been doing identity theft" or something - that it really isn't like that at all.

We live in the United States of America, we are ALL entitled to a court appointed defense attorney.

Even being familiar with parole, i still have no clue what "thing" he could sign, that is "legal" that could add another year to his sentence .Chat Icon

Not everything that requires popcorn is funny at all. It did go in the direction of the long threads that one can watch for quite a while, so my comment is not exactly false. This may sound harsh but all terms of parole have to do with either being law abiding or acting with morality. A person does not get violated for acting like a Polyanna or for associating with people who do. That's why there is some suspicion of whatever act it was that you did. I'm not saying that the punishment fits the crime because a lot of things in the system are very unfair. If you are a regular poster and you know me, you know that I feel that way.

Ok this makes more sense. The way I was reading her post wa sthat they HAD spoke to the parole officer and it WAS approved and then out of nowhere he was rearrested. I also agree that it sounds weird, but I don't know the situation. All I can say is good luck and if talking to someone will help I would do it!

Ok I am still lost but you said you did this for him. That it was his thing. You were trying to do something for him (I assume a nice thing) so you shouldn't feel bad. If you read the paper work and nothing was mentioned about this than it really wasn't your fault.

I would hope that he would be able to get a court ordered attorney. Maybe call around and see if a local lawyer will do something pro bono for him/

I'm sorry your friend is back in jail, Know it's not your fault you didn't do this with the intention of knowing that he would go back to jail it was a misunderstanding, Maybe they will come around and let him out of jail earlier if he can get a trial and explain what happened... He couldn't afford an attorney. He had legal aid. They did nothing. When they gave him his sentence to go back to prison it was like a board meeting...

Again, I didn't do anything illegal nor was it shady. It was something that everyone uses and deals with in everyday life. That's what he wanted. To be like everyone else. Being that he was locked up for so many years, he knows that he missed out on A LOT... I was just trying to help him. So while yes he did agree to let me do this "for" him, I'm still the one that did it. I approached him about it...

Sorry I will not shell out any details regarding this but I can't take any chances with peope who know him as well as myself IRL...

You do not need to explain why you cannot give details, clearly its a situation that you cannot give details on. I'm so sorry you feel responsible, but how could you have known this would happen? You had his permission to use his name for whatever reason you did (and I now have a feeling that I know what you're getting at), and so you can't take all the blame or feel bad. How does he feel about it? Is he mad at you? Hang in there.

Im very sorry for the both of you...

I had a friend of mine who was in a similar situation as you..although it was many years ago...

She got her friend a cell phone b/c he had no credit and wasnt able to get one on his own..(I dont know if this was before the prepaid or what the situation was)..but anyway...his parole officer found it to be a viloation of his parole somehow..

I find it so crazy really. I had another friend of mine who was out on parole for a drug related charge. She was in constant constant constant violation of her parole...for a variety of reasons her family wanted her to get caught in violation...the many phone calls to her PO went unanswered. It was very frustrating for them.
