NYS Disability?
What do they pay weekly for FMLA (maternity)? I know I will only get 6wks because I work for a small company.
Not preggers yet.. just planning.

NYS does not pay for FMLA. They will pay you $170 per week for disability after you have the baby. You get 6 weeks for a natural delivery and 8 weeks for a c-section. Though you do not get paid for the first week.
For FMLA you are entitled to 12 weeks off. Some companies include the time you took for disability and some companies do not. Also, depending on the size of your company you may not be offered FMLA. I think that they have to have at least 50 employees in 1 location, but I am not sure. Though I am sure someone else on this board can answer it.
Also, for FMLA you have to be with your company for at least 1 year.

$34 a day/$170 a week is the max they pay during your 6 or 8 weeks of disability post delivery

If you work for a small company you are not covered under FMLA, which protects your job for up to 12 weeks.
You can get NYS Disability, which is $170 a week, less taxes and you get for 6 weeks vaginal, and 8 weeks c-section.
Unless you have a MEDICAL REASON to be out (and I had preeclampsia and it didn't count) you do not get paid til the baby is born.

My company has less than 50 employees so I know no FMLA.
So I guess unemployment pays better than disability? What a joke.

FMLA and disability are totally different.
FMLA guarantees you can keep your job or a similar position for 12 weeks per calendar year. Some of the requirements are 1 year, 1250 hours and 50 employess. It is umpaid. I just guarantees you cannot be let go by your employer while on leave.
Disability is paid by NY State. It is $34 per day, $170 per week MAX. That means if you work PT you could get less.
NY State pays you 6 weeks per vaginal and 8 week for a c-section. You will actually be paid for 5 weeks and 7 weeks since it takes 1 week to take effect.
In actuality NY State pays up to 26 weeks per year for disability. Including per rest, etc... but it needs to be an actual diagnostic by a Dr. like Pre-eclempsia.

so the 170 a week is NOT FMLA??? It's just straight disability...sorry I'm all sorts of confused bc I my company is small and I am not entitled to FMLA....

That's right, the $170 is from NYS Disabilty. FMLA is a federal act protecting you from losing your job due to time off for family medical reasons; it does not have anything to do with compensation while on leave.
It's not really cra p, it just has a different purpose.
