Help- Is this true?

I called the County Clerk in Hempstead

and they told me inorder to have my DH change his last name to mine- we have to get remarried?

is this true???

Why is that! The only thing I can think of is your marriage lisence does not show your last name with his first name.

I remember when DH & I filled out the marriage license paperwork, I had to state that I was taking his name.

so maybe that's why? Chat Icon that doesn't seem right though.

I remember then telling me that also

and I called and they told me that

so we are going tomorrow!

I need to get someone to remarry us

I called my Uncle- b/c on the website it says former mayors can marry you - and he use to be mayor of a town on LI- other wise I have to pay someone!

No. That isn't true. That is the only way to do it so its free- but your DH can pay to have his name change.

anyone can change their name to anything anytime for a fee...as long as its not being done to create an alias to avoid something bad.
Most people hire attorneys, they file the paperwork, run a public notice & wait for a judge to approve it.
I don't see how you could get remarried if you're not divorced, the paperwork is already done.

You don't have to get remarried. You just have to have him file a name change form with the clerks office. With a little bit of $$, the town can do anythingChat Icon

I was going to say, why not just do a name change through the courts? It is a fairly simple process and can be done for any reason, really. I know a great lawyer who is reasonable and he does this in the city (not sure if he does it in the boroughs, but I think so).

You get a few options at the time you get your marriage license. We were debating this as well- he was going to take my name, then we were going to make a combo name. I was never going to take his name from the beginning. In the end I kept my name, he kept his and the male kids will have my name and the female kids will have his.

I've seen stories about several men suing somebody because women can change their names for free without any special forms other than a marriage certificate. Men, however, had to go through the entire legal/court process. Not sure if that applies locally, but in general, it's not as easy for men to change their name as it is for women.

i think it would be easier than getting divorced and remarried. How to do it depends on where you live.

from what i remember...

in the state of ny, when you fill out the paperwork for a marriage license, there is a place (for each person) where you fill out the new sur-name.

i'm not sure about having to get re-married.

also, i know that an adult who is not hiding from the law can change his/her name at ANY time WITHOUT filling out any legal paperwork. it would be the same way celebrities change their names. i had looked into this years ago, so i don't remember ALL the details.

i have a cousin who did this. he just started filling paperwork with his step-father's last name and he never had a problem.

yes- and I put down that I was going to take his- which was silly b/c that was never an option

we are going to the town clerk today- I want to talk to them in person and see what we have to do

but when I told them over the phone what I wanted to do- they said to come down and get another marriage lic

so I don't think we have to get divorced- just refile the paper workd with my DH taking my last name

if it's not that simple- he will do a legal name change
