Re: Guns
Legal but:
1. There should be a waiting period 2. Persons wanting to own a handgun should go through a screening process 3. Not all guns should be legal

Should we dismiss anything not written within x many years of current?

and yes, I don't think it should be re-written.
and BTW - the 1st thing Hitler did when he came to power was take away every citizens gun. that's reason enough for me!

Re: Guns
Lawyer answer: The question is too broad. I cannot answer yes or no whether they should be legal. If I said no, would that mean that I do not want cops to have them?
To try to give an idea as to how I feel: I believe in VERY strict gun control. The right to bear arms, as set forth in the Constitution did not contemplate today's situations and I think that strict gun control is constitutional and necessary.

Re: Guns
I think they should be legal, but restrictions should be MUCH tougher. I'm of the school of thought that the right to bear arms as mentioned in the Constitution pertained, at the time, to the fact that the United States & it's territories/surrounding areas was vastly undeveloped - a frontier. Hunting was a way of life much more common than it has been in recent times, there was the question of using arms during wars fought on our soil, etc. After all, the Constitution was drafted during the revolution.
That's a bit garbled; I'm not a Constitutional scholar, but you get the gist of what I meant.

I agree with all of these and want to add:
There is a screening process however it needs to be more in depth.
4. A provision of the Violence Against Women Act requires that anyone with a court order of protection against them is ordered to surrender all firearms. Problem is, it isn't enforceable. If the person denies having said weapons and they aren't registered, law enforcement has no means of confiscating the weapon. Orders of Protection should also have a search warrant provision in them that allows law enforcement to search the property for weapons as opposed to just taking the bad guys word for it that they don't have any.
That's not to say that another weapon cannot be obtained, however it would make it a bit more difficult.

ITA. I believe that the "right to bear arms" meant something pretty different from how its interpreted today.

legal. it's in the consitution

Its actually an amendment to the Constitution, the first 10 amendments were the Bill of Rights. And there are loads of other things in the Constitution that required later clarification (woman's voting rights, racial rights, no slavery). I think what Jess is saying is that just because its in the Consitution doesn't mean it shouldn't be modified.
Also, let's not forget the entire text of the Second Amendment: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." The full text, and the reference to Militia seem to suggest the purpose for which the Amendment was meant to serve, which many feel is now out of date. I personally believe (just my two cents) that too many people read "the right of the people to keep and bear arms" out of context.

Re: Guns
LEGAL!!!!!
DH is a cop and some politician doesnt want the cops to carry guns. That is an INSANE idea. And not for nothing, DH and I have spoken about me getting a gun permit b/c he wants me to know how to use his guns. He arrests gang members and trash all the time. Some of have made verbal threats to him and other cops he works with about hurting their families. I'll be damned if someone is going to come into my house and try to hurt my family, especially my baby. And than what, our justice system is so great, they will be back out on the street like a$$holes that just shot the 2 cops.
I agree there should be a strong screening process and a gun should not be handed to just anyone. But, they should definetely be legal.
ETA: It doesnt matter whether guns are legal or illegal, a majority of the guns on the streets now used in violent crimes are ILLEGAL bought on the black market anyway. Legal or illegal, guns will still be sold to the wrong people and fall into the wrong hands. Honestly, I think the cops should be given more leeway into getting guns off the streets. Convicted criminals are out on the streets to fast b/c the jails are too crowded. They go back out and do the same $hit over and over again. In the city, where this is a huge issue, cops dont have the freedom to do what they have to do to get guns off the streets b/c everyone and their brothers makes civilian complains constantly, which are mostly false. Cops should be able to do their jobs without any interference from the public.

Re: Guns
illegal, I believe in people's rights, but I think they do more harm then good.
How many times do guns wind up in the wrong hands? Angry teens taking guns from parent's collections or curious children playing.
I never understood how a gun would protect from an intruder
Do you ask the robber for a timeout while you grab the key to unlock the box to pull the gun out to load it...
