FMLA

So I work for a company, where let's just say our HR rep is lacking...anyway, for the FMLA she is stating I get 8 weeks for a vaginal delivery and 12 weeks for a c-section. I thought it was 12 weeks for a vaginal delivery??? Does anyone know?

FMLA has nothing to do with the type of delivery you have. If you're eligible, you're entitled to 12 weeks unpaid leave.

nys pays for 6weeks for vaginal and 8 weeks for c-section,

FMLA means you can elect to take off UNPAID up to 13 weeks and your job will be there when you return.

As previous posters have noted, FMLA essentially just protects your job for upto 12 weeks. Has nothing to do persay with pay.

In my case, I can take 12 weeks utilizing FMLA and my job is held for me.

I only get paid Short Term Disability (STD), which is 6 weeks for vaginal birth or 8 weeks for c-section. This STD is only a portion of my current wages.

She's confusing Short Term Disability (STD) and FMLA.

All FMLA does is protect your job for up to 12 weeks. That 12 weeks can be for medical reasons, for taking care of the baby or a combination.

STD is what PAYS you for the time you are medically unable to work. 6 weeks for a Vaginal and 8 weeks for a C-Section.

They run cocurrently. So for 6 or 8 weeks you will get paid for the STD, and during that time they are also counting against your 12 weeks FMLA.

So theoretically, if you decide to take all 12 weeks of FMLA, and have a vaginal birth, your first 6 weeks will be paid, then you will have 6 weeks unpaid, should you choose to take them.

Thanks...that's what I thought as well, but again our HR rep is not the brightest bulb, so I wanted to make sure.

my company only pays 6 weeks for any kind of delivery. They only pay for 8 weeks if you have complications in recovering for a c-section

Yes the state STD pays only up to $170 a week for 6 weeks for a vaginal delivery and 8 weeks for a C-section. FMLA is different.

Covered employers must grant an eligible employee up to a total of 12 workweeks of unpaid leave during any 12-month period for one or more of the following reasons:

for the birth and care of the newborn child of the employee;
for placement with the employee of a son or daughter for adoption or foster care;
to care for an immediate family member (spouse, child, or parent) with a serious health condition; or
to take medical leave when the employee is unable to work because of a serious health condition.

You have to have over 50 employees in your company and have worked a cerain numner of hours and I think you have to be there for at least a year. It has nothing to do with how much the company will pay you during this time. They don't have to pay anything!

It depends on your employer. We have STD insurance through my employer. It's 75% of our income. It kicks in 7 days after you are off.

I just wanted to add that $170 is the minimum they have to pay you by law.

Some companies do have more generous policies.

For example, our company pays 100% for every two weeks equivalent to your years of service and then 70% for all weeks thereafter.

So for 3 years of service I can get up to 6 weeks at full pay.

Make sure you hound your HR rep until you are completely clear and stay on top of things while you are out.

One more thing to add: The first 7 days are a "waiting period" where you do not get paid under NYS Disability. So, in my case, I have asked my doctor to put me out on disability one week prior to my c-section so I am covered for the waiting period (I will use my vacation time for the week)

FMLA is 12 weeks of unpaid leave.

You may be eligible to receive disability pay:
6 weeks for vaginal delivery
8 weeks for c-section

oh okay....I just wanted to give you a heads up because I see alot of prego's wh go out on maternity leave that do this and then get upset when they have to return to work 1 week earlier.....

Same here...FMLA has nothing to do with STD...FMLA is in addition to the STD...if you want to take extra 3 months you're entitled to but unpaid.
