No unemployment benefits for unvaccinated New Yorkers
Why don’t they just mandate it for all adults and call it a day? These one by one measures to get everyone to get vaccinated without calling it a mandate is getting a little ridiculous.

When does a vaccinated person turn into an unvaccinated person? My friend got vaccinated in january and has no intentions of getting a booster. At what point does he switch into the unvaccinated category?

That's a great question.
I believe I am entitled to my booster in December but according to NYS excelsior, which is apparently all knowing, I am good until May.
Also, how dare the state revoke a benefit meant to assist a NYS TAXPAYER in their time of need to promote their own agenda. Does this unemployed person get their tax payments back for the last year?
I am so outraged by all of this. There is a LOT of opposition to the Texas abortion law, right? Women deserve autonomy, blah blah blah. That should be across the board. This is tyrannical and abuse of governmental power. I sincerely hope people remember this on election day.

TBH, I don't know. Employment law is outside my personal skill set so I would have to ask my colleagues but I don't know how that is legal. You are entitled to unemployment if you are terminated but I don't know if there is a caveat as to the reason you are terminated. But I would imagine that people who get terminated for sexually harassing a co-worker, stealing from the company or some other act of moral turpitude are still entitled to benefits. But not if you won't get a vaccination that could maybe perhaps prevent you from getting sick? Ummmm..excuse me?
I find our government is using the "in the interest of the public at large" as a shield for their own political agendas. This new governor is scary. She is Sarah Palin dressed as a democrat. Total cowgirl with something to prove.

So they are penalizing people for not getting a shot that wears off in 2 months anyway. It is absolutely ridiculous and the world is going to shit.
I do think that they are saying this to protect the businesses from paying an exorbitant amount of unemployment benefits due to the state mandating certain businesses to follow the stupid the mandates. So again, people are paying the price for political games.

I don’t think they legally can so this piecemeal crap is their way to get there.
They are making it as a condition of employment and if you are terminated by not meeting all conditions of employment, typically you aren’t entitled to unemployment.

Can I get unemployment?

You don’t need a shot to get unemployment if you are terminated UNLESS you are terminated because you did not get a shot, in which case no unemployment for you. I think our lovely governor made that rule. Because you know. Science.

When someone is laid off, the employer is sent a form saying that employee has filed an unemployment claim. If the employer does not dispute, as in the case you described, he does nothing and you can get unemployment.
If it is due to the vaccine, an employer can do nothing and let you collect or he can dispute it- I forget the categories, but basically a form of insubordination. You can then request a hearing.

I think it was announced a couple of weeks ago ahead of the healthcare workers being fired for not getting vaccinated. But it was appearing in my news feed yesterday.

If you are let go for a cost cutting layoff, you can still get unemployment (well, there are other things like severance and whatnot that may impact that but, your vaccination status will not impact it).

OK thanks. I had heard that in reference to the healthcare workers who were fired for refusing the vaccine. I thought maybe they decided to really go balls to the wall and say the vaccine is a condition of collecting unemployment for ANY reason.
And the sad part is, I wouldn't put that past them either.

Yes. The ptoblem is that laws no longer matter. Nobody cares about laws - it is now all about executive orders and mandates and mob rule and propaganda and fear. You can break the law and no consequences. You can shoplift freely and no jail. You can discriminate all you want and are rewarded. This is the new America. This is what people wanted. And they got it.

If you are let go for a cost cutting layoff, you can still get unemployment (well, there are other things like severance and whatnot that may impact that but, your vaccination status will not impact it).
The problem is that for most people they were working at these jobs, paying unemployment taxes, long before a covid vaccination mandate. It's truly unfair to say that you can't collect unemployment when the company changes a policy or puts a new policy in place and you are let go because of it. For example, if your company relocates to another city and you don't want to make the move, you qualify for unemployment. This has to be illegal.
