Tenant Vent

Sorry, this is just a vent but I can't post on my Facebook and I need to let it out!

We bought a condo back in 2005 at the height of the market. When we had kids, both have special needs and we wanted a better school district for them. We could not sell the condo because the market tanked and it was about 100,000 under water. We decided to keep the condo and rent it and we moved into an apartment in the district we wanted, later to buy house there. Every month, even with the rent, we are losing about 900 a month on the condo, mortgage and HOA fees.

Fast forward to now, the market is great. The prices are finally back to what we bought for in 2005. We have had tenants for about 2 years now and they are great, pay on time, etc. I told him in February that we would not be renewing their lease which ends April 30th. It was done formally in a certified letter with a call to them from myself. They were shocked but whatever they had plenty of time to move. The tenant was there with me for all showings. I told them immediately when the offer was accepted and the contract signed. Each time reiterating they needed to be out by the end of the lease. I am scheduled to close on the condo May 3rd.

Well yesterday, they send me a letter that they will not leave until June 6th and that they decided to buy a house and it is too inconvenient for them to leave on April 30th. It is literally against the law for them to stay past the lease end date and they do not care. My buyer is going to be pissed and probably cancel the sale. Then I am out the rent for the time they are staying there past April 30th and then all mortgage payments until it gets sold again. I am so pissed. I don't know what is wrong with this younger generation thinking they can do whatever they want. Karma is a *****.

If it's against the law, is there anything you can do? A lawyer?
I swear to you the laws in NY are terrible when it comes to this.
We had squatters living in a house across the street for close to 10 years before the town was able to auction the property and then the buyer from the auction had to bribe them with $5K each to get out so he could start flipping it- otherwise they would just stay until the courts kicked them out which could take forever

This is so frustrating. I hated being a landlord.
The worst. The problem with all of this is that any action you take will take longer to resolve than 6/6. First, I would call them and tell them they can take their letter and shove and they need to get the f out as they knew well in advance of the situation and YOU shouuldn't be the one inconvenienced. Then, in a more civilized fashion, I would send them another formal letter stating they were aware of the non-renewal of the lease on ---- date and that they must vacate the premises by 4/30. Also, say you are keeping their security as damages if they don't leave.

Also, I am a lawyer and I do real estate from time to time. The God's honest truth is that your buyer might be jumping up and down but after they have invested the money into a title search, etc. they aren't going to walk over 4 weeks. I would keep it on the DL until their lawyer starts asking to schedule the closing. I wouldn't give them this much of a heads up.

FYI, even if courts were running per usual, Landlords almost always get screwed. They are being really inconsiderate. Wow.

I already responded to their letter saying they need to get out in a very civilized manner with the attached lease and a page from the NYS court website that described the laws. I sent them an official One Month to Vacate Form along with my letter to get the F out.

We'll see what the buyer says but she is selling her house too and has no place to live....we'll see but regardless I wish that the way that I'm feeling I wish the movie the Purge was a real thing lol.

Did that lol. They are convinced they are right and that they should not be inconvenienced to move before they are ready. They said they should not have to look for a short term place to live because it is a pandemic and I need to be more "understanding". They are delusional. They just just entitled millennials and I will do everything in my legal power now to crush them.

It depends on when in February you told them. There are new laws that were signed in for tenants…If they were there for two years, you have to give 90 days notice.

I also will add that I wonder why you didn’t tell them sooner that you were thinking about putting it on the market? Prices have been skyrocketing all over Long Island… This isn’t a sudden burst of increasing home values. It’s been going on for well over a year now.

It sounds as though you wanted to wait to time it out perfectly on your end, that your plan all along has been to sell at some point.

Too many landlords purposely wait until the last minute to make a big announcement because they don’t want to lose their perfectly good tenants. They want to use them right up until they’re ready to spit them out without any regard to how disruptive it can be… Especially when you wrote “they were shocked but whatever they have time to move”. It’s not easy. They were probably under the impression that they were great tenants and had a good relationship with you since they paid on time. Renters know it’s hard to find great reliable renters. You even wrote that they were really good and they paid the rent on time… So then why didn’t you give them more notice, just like a heads up? It sounds like you probably didn’t want them to leave you in the lurch.

It’s not easy being a landlord (I know full well) but all too often the landlords only care about their position without any regard to how disruptive it can be to their renters.

I’m not excusing their behavior, but I’m offering another perspective. Being a landlord is a really important responsibility on many levels. While it’s just a passive income stream/investment (short term or otherwise) it’s someone’s home and stability.

I think you should’ve given them more advanced notice.

And again I’m not excusing their behavior.

As long as she gave them the 90 day notice as required by the Covid eviction law then she is fine. That is the risk you take when you rent.

I hate to tell you, this is a law that is not enforced. NY State is a tenant's rights state. Yes, eventually they will be evicted, but what used to be a 6-8 month process is now a 2 year+ since Covid. Also the eviction moratorium keeps getting extended. I don't think the courts are even open for this yet. Your tenants can decide to stop paying you rent and you still won't get them out for a couple of years. Being a landlord in this state is rough. I can tell you stories.

They aren't delusional, they are right. Unfortunately you have no "legal power" no matter what you think. You're real estate attorney will tell you this.

Not if it is end of lease. The lease was not renewed. And even if it was 90 days it is still well before June 6th. I double checked that too.

I don't have a legal right to my property? They signed a lease and are breaking it. They are 100% in the wrong. It is different if I was asking them to leave early or if it was a non payment issue but I have every right to not renew a lease. I don't even need cause. I did contact many real estate lawyers.

I'm not saying they are not in the wrong. I am telling you how it works. Hopefully they will leave on their own accord soon. If they don't , you can serve them with an eviction notice and it will be 2 years until they are out if they choose to not leave. Your lawyer will tell you this. Get a landlord/tenant attorney. Being a landlord in NY is a huge headache!!! People tend to suck. Good luck.

I agree with all of this. To proceed with an eviction (that isn’t going to remove them anyway) over a month is ludicrous. You’re allowed to push your closing date 30 days. Your buyer isn’t going to walk over something so insignificant.

I did not tell them sooner because I was trying to do the right thing by timing the sale of the condo to the end of their lease date. I told them in the appropriate time I should have. Just like any apartment complex would do. I have the right to not renew their lease. I was not kicking them out early.

Why would I give the tenants more than 2.5 months notice that their lease was ending? Maybe it should have been 2 weeks earlier but technically they are suppose to ask to renew the lease and they did not and they agreed to move when I told them back in February, until this week. They decided they wanted to buy a house instead of renting something else which is not my problem.

They are wrong, plain and simple. When you sign a contract you abide by the contract. That is the problem with the world today. Everyone things they can bend the rules to suit themselves. I bent over backwards for them during the pandemic and I know its my fault for trying to do the right thing but I will never ever do it again. Shame on me for thinking the majority of people want to do the right thing.

I don't know what the buyer is going to do, and she might be fine with it. As I said I was just venting because it was sucky thing for them to do.

Edited to add: The closing date is April 6th. With agreement it would not be until the first week of May. It is scheduled for May 3rd so the 30 days have passed.

Wasn't the moratorium on evictions just extended? I would look into that - I unfortunately do not think there is going to be anything that you can do.

I agree as well. The renters’ behavior is not the best. Personally, I would concentrate on talking to the buyers and making sure you won’t lose them. That’s really the only thing you can control right now because taking them to court isn’t going to give you quick results.

I think she said that they had a limited lease anyway. I’m not sure how it applies to the eviction law, though. I think it should be included because of the pandemic situation, tbh.

I know they were talking about extending it. I agree with others, I don’t think the OP had much leeway in getting them out especially with Covid.

Are they really buying a house? If not try to give them incentive to move, so the offer doesn’t fall through. I know it sucks but it’s up to you on what you’re willing to do.

We pulled out of a contract because the seller could not get the renter out of the house. They wanted us to inherit the problem and she was on a month to month lease. We waited for 3 month. I think their credit was shot and they were on unemployment and couldn’t get a place. The seller had their agent helping them find a place and was giving them 5k, yet they still couldn’t get them out. This was in Nov. so maybe it’s better now.

I know right now when we look at a house and it’s listed as occupied. We are hesitant to see it because how hard it is to get people evicted right now.
