Dying without a will?
Has anyone gone through the probate process for a relative who passed away without a will? My mom died a month ago and she did not have a will. There isn't much money, but she has a house, car, safe deposit box. I'm contacting attorneys to help with the process. But I'm just curious if anyone has gone through this process and how difficult/annoying was it?

i'm sorry about your loss.
hopefully, it won't be too bad, but just be prepared.
like everything in the law, how complicated it can be depends on a lot of factors.
how many children survive her, how much debt she had, did she have designated beneficiaries, etc.
i'll be praying that it will be a smooth process for you.

I am sorry about your mom
It isn't probate. You need to file to be appointed the administrator of the estate. I don't really feel you need a lawyer. The papers are on the court website and if you go to Surrogate's Court, they can help you

My mom died without a will as well.
My brother got appointed administrator, we split everything 50/50. Almost all completely done within 30 days. Her house was already in contract for sale before she passed, so we just had to wait to close.
Sorry for your loss.

I'm going back and forth with using an attorney. I think I could do it myself, but would like to consult with an attorney about a few issues. I have a consultation set up Monday. I'd have to file in Rockland County and I'm on LI so I have that headache too.

Yes definitely a reminder to have a will. My mom had metastatic lung cancer so while she ended up passing quickly, it wasn't a surprise. We had been pushing her to get something in place and she would refuse. It really puts extra stress on your loved ones during an already tough time.

DH and I need to do this except we don’t know who to leave DD to because we generally can’t stand anyone.

I agree with this. I’m so sorry for your loss. My dad passed without a will, and we made my brother the administrator of the estate. Does your mom have a spouse? For us, everything went to my mom, so it worked out fairly simply, and we just filed it all ourselves.
