So as an update. The damage- for this minor fender bender- was over $6K! The guy who backed into us had zero damage as he hit us with his tow hitch.
Parts for this car are apparently quite expensive!

And then, right after I posted this, the insurance company sent us the form we have to fill out for the DMV and instructions to fill it out and send it in.
So I guess your insurance either does it for you or they send it to you to do?

Either way, this report looked EXACTLY like the police report and had that much detail. You even had to draw pictures. DH, who was a cop and is an expert at filling these things out took quite a while working on it.
Why on earth the DMV can't just get a copy of the police report forwarded to them is beyond me. they have no way of knowing if we are lying on that form anyway, Wouldn't it be better to have an official version from the police?

Haha I said the same thing. Its just like the police report so I pretty much copied that.

Sounds like what happened to me in June. Ford f-150 truck backed into my explorer.
$18,000 of damage and 28 days in the shop

I’m under the impression that your insurance does it for you. If you don’t report to your insurance company then you have to notify the DMV yourself. At least this is how it worked in NJ.

The report the police wrote for my accident had incorrect information in it. (The weather, number of people in the car, etc).

By submitting your own form you are legally giving a statement (that is supposed to be truthful) discussing your side of the story. To take the cop's word over the people that were actually in the accident would be a mistake.



Right but we gave the cop all the information at the scene and he wrote the report word for word what we said and what the other driver said.
I saw the actual police report and it was verbatim.
If he was lying, how do we prove it? It's then a he said/she said.
I thought the reason for a police report was to get an unbiased report of the accident.
Because the people involved are more likely to lie IMO. The cop has no vested interest in who is at fault.



You should have seen the report a cop wrote for our car accident in 2009. He wrote 2 sentences and forgot that my DS was in the car. He also failed to cite the other driver for anything, so I called my LT at the time ((different precinct)) and had him walk me through it all. We were able to do a couple civilian tickets, and she got points on her license, no thanks to the officer at the scene. I’ve read a ton of accident reports and I’d say the majority are usually well done, but you will find some that were either too lazy, got sidetracked or whatever else. So it’s important that people have options to write something better to their insurance/dmv. Glad your officer was thorough though! And I hope it’s not too big of a headache for you guys!

So I guess I will see what estimate comes back because I'm not sure if I have over 1k of damage yet, but it's so confusing, because what if the other driver does have over 1k damage? I thought the police report gets sent to the DMV anyway...

If you need to fill it out, your insurance co will send it to you.
In our case he had NO damage and we had $7K worth of damage
After our adjuster came and gave the estimate, the letter with the form to fill out was sent.
So I guess they wait to see the damage and if it's over $1k, then they send it

Carfax gets the data from insurance companies as well as the DMV and police reports. It really depends on how major the accident is. I think the DMV report is for accidents over $1K, not $100.

If you filed a police report, it may be on the car fax. If you went through insurance, it may be on the car fax. I have filed the DMV report in the past, but likely would only do it for a large accident.

I jsut got royally screwed by carfax in that they reported an accident on my car as "structural damage" due to some coding on the insurance companies side. When in reality, it wasn't a big accident and the part replaced related to "frame" was a $75 part. Now I'm stuck begging people to consider my car at thousands less than what the car would go for normally.



Contact carfax. You can get it off. Dont settle if its wrong.

Yeah I didn't get it either but it was listed right on the police report that we needed to report to DMV for accidents with damage over $1k and sure enough our insurance co sent us the form and said we had to fill it out and submit to NYS.

correct- any incident after 2k has to be reported by you, the claimant/ policyholder.

its a replica of the accident report. Just follow that.

In the insurance biz.

As for not doing it, they can suspend license and what not. its happened before.

Never did this before. I think this is something the insurance company reports on your behalf. I don't know anybody else that ever did it either.

Ok so now I have an updated question. I got an estimate from the other driver's insurance company, they are saying the damage is $360. This was just based on pictures I took which does not show full damage. I know that my auto body shop is going to charge a lot more because they said the entire bumper needs to be replaced and my sensors fixed. I'm not taking my car there till next week (they asked me to bring it in on Tuesday when it's a slower day for them) so I won't really know the cost of the damages until they look at it... so how am I supposed to file this within 10 days if I don't even know if the damage exceeds 1k?

My ins agent says the 10 day thing is a scare tactic. But im sure if you dont do it or within a reasonable time they could suspend your license

True. The way the NYS DMV works so slow, they probably won't even realize this until a year and a half from now.

I am going to assume that insurance does this.

My auto body says to never use the picture upload/assessment method. Instead, insist to have an adjuster come to the shop. Otherwise this happens where they dont assess the right damage then they end up having to put in revisions, etc.

Yeah how they estimate anything based on pictures? How can they know what structural damage there is?
Our front grill ALONE cost $1000 to replace.
Get the eff out of here with that.
