NYC Legislation against Email Outside of Work Hours

As someone who receives emails from her boss at all hours of the day, night and weekend, I hope this law gains some traction. Unfortunately I am not in NYC.

Tired of having to check work email after hours? New Yorkers may not have to, if this bill passes

Getting work emails from your boss when you're off the clock? There ought to be a law against that.

Well, in New York City, there just might be.

Rafael Espinal, a city council member from Brooklyn, introduced a bill last week that would make it illegal for businesses to contact employees via email or instant message when employees are off work.

The "Disconnecting From Work" bill would only apply to businesses with 10 or more employees and forbid communication when workers are off duty, on vacation, using personal days or off sick.

"There's a lot of New Yorkers out there that don't know when their work day begins or when their work day ends, because we're all so tied to our phones," Espinal told CNN affiliate WCBS. "You can still work, you can still talk to your boss, but this just is saying that, when you feel like you've hit your boiling point and you can't do it anymore, you're able to disconnect and decompress for a while."

(CNN has reached out to Espinal and is waiting to hear back.)

Employers who violate this would pay a fine of $250 and $500 to the employee.

There would be exceptions for employees who work overtime or who are on call 24 hours a day.

The bill is currently in the council's Consumer Affairs and Business Licensing Committee. It's similar to a law in France which gives workers there to right to ignore business emails that pop up in inboxes after work hours.

Espinal has gotten novel legislation through the council before. Last year, he sponsored a bill that established the Office of Nightlife, which oversees New York's nightspots, and created the city's first "nightlife mayor."

Mayor Bill de Blasio signed that measure into law last fall.

Honestly, in my job, it's just par for the course. Many of our customers have 24/7 contracts with us that they pay a premium for.
I knew when I signed up for my job that I might have to look at my emails after hours or on weekends and occasionally respond to something.
To me, it's not a big deal.
As a manger, I am responsible for the customer's experience. It's in my job description.
I'm not on call 24/7 per se, but if there is an issue with a customer, I'm expected to handle it. It doesn't happen very often.
And I'm compensated well for it.
The reality is there are a lot of jobs out there that aren't 9-5 anymore.

If you receive emails from your boss during your hours off like weekends or evenings, are you required to respond to them? Maybe I'm naive because I don't have that kind of job, but what if you just don't pay them any mind or even open them until you're actually at work? Not sure how feasible that is. I think it's crazy for bosses to expect you to be paying attention to emails during off hours.

Woo hoo!!!! I really hope this goes through. I work for a University and some managers expect their employees to be available around the clock....and if you don't see an email, you get a text. Vacation Day, Sick day, doesn't matter...and I'm not in a managerial role. My job does not require being available all hours, we aren't saving any lives.

At higher level jobs, emails outside of working hours are expected and I find it highly unlikely that this law will actually change anything.

Interestingly, there is much more of an expectation at my current job, on LI, to answer emails during non work hours than there was at my old job in the city.

I would guess if they don't mind getting the emails on the weekend or nights because they have flexibility in their work schedule, they just wont' report it.
This can only be enforced if people are reporting that their boss is bothering them after hours.

I email people after hours & weekends but by no means do I expect a reply. Sometimes things come up or I remember something that I need them to do so I email them when it pops into my head. Emailing and expecting them to work/reply while off is another story

I don't get paid enough or have a high enough title to work after hours reading e-mails. When I did do major work while on vacation a few years ago, it wasn't appreciated and it never happened again.

Another thing that happens in my company is they pay for your cell phone for certain job titles. If you have a job where they pay for your cell phone, you are expected to at least look at emails after hours and if you see something that looks urgent, answer it.
If you chose not to use your cell for that, they can pull your cell allowance.

This!

This would be terrible for me. With 3 kids 5 and under, I treasure the ability to head out the door at 5PM and don't mind one bit answering emails after they all go to bed. If I had to stick around and only do work during hours I was in the office, I would never see my kids when they were awake.

At my dh company you don't have a choice not to take their cell phone. You get a company phone because of confidential files and financial data that is stored. Nothing personal goes on that phone. It is a real pain for him to carry about 2 cell phones.

There is no way my dh could do his job without looking and responding to emails at home. He would have to stay at this office until 11 at night. I think too many are already use to doing business this way to go back. I highly doubt this will go anywhere.

I would LOVE this!! My job THINKS everyone is on call, and they aren’t, but it’s the expectation, I hope this passes and the people that truly need to be called hopefully they can get a nice increase to actually be on call!! Family life needs to be valued more where we live! My job is extremely flexible with my hours which I love but I don’t want to work more than my 35 hours, my kids are only little once!

Sorry, but as a low level employee after I do my 50 + hours a week, I don't want to be bothered!

I’m sure thing are going to end well for the person who reports their boss for emailing at night......

I don’t like answering emails at night, either. HelI, don’t like answering emails while I’m AT work. But the fact of the matter is, in many industries, strict 9-5 doesn’t cut it anymore. I’m not saying that’s a good thing, but it’s reality and if you work in one of these industries and want to climb the ladder, you do what you need to do.

Also, this is only for NYC. If you work on LI it means nothing.

Yes that is what I meant.
I was trying to say that if you want to work after hours for whatever reason- like the poster here stated how she likes to leave at 5 pm to get her kids and then catch up on emails later- you still can.
If you don't want to, you don't have to.
When I said bothered- I meant you don't want to be bothered or disturbed by emails

let's face it, they can pass all the laws they want but at the end of the day, who do you think is going to get the promotion between 2 people with all else equal- the one who responds to emails at night or on weekends or the one who hides behind this law?
Unfortunately this law won't really do much.

I don't see how this law could work. How would I know whether someone is out sick or on leave? Of if you inadvertently send something after hours because it's a different time zone? Or, if you are sending a big group email do you need to figure out who to take off the list based on the time of day? It's just silly. Sure, I can see not requiring an employee to RESPOND to an email during certain times but you can't punish people for sending them!

Interesting. My entire group won’t check emails after hours. It’s a good thing to totally disconnect every night. I used to work with this lady who seriously had no life. I would get to work Monday mornings and have a full inbox of her $hit. I couldn’t stand it!
