Legal zoom-need a notary for will

Cannot find a notary in nassau county for our wills. Have tried banks, ups, post office, town clerk, our cpa. All have said to use the attny who drew up the will but of course we dont have one. Can someone recommend a notary that can do this for our wills? Money is tight which is why we went through LZ.

Have you tried real estate offices? There's usually a notary there.

They places you tried won't do it? Or can't? I had to get papers noterized recently for a small inheritance and Astoria bank and teachers federal credit union does it for customers and also some State Farm insurance brokers do it too. Not sure if you have any of those. Also, my friend does it and she said they aren't allowed to charge much at all. I believe it's under $5 for each page that needs it.

The places won't do it-specifically wills. I thought maybe I need to leave nassau county. It is so frustrating! Even when I called customer service they were a bit baffled.

Quick question: Did you already sign the document and they are refusing to notarize it or are they unwilling to notarize a document that you signed in front of them?

Also, are you asking them to witness the will in addition to notarizing it?

Why won't they notarized? If you are willing to take a drive to Medford my SIL will do it for you.

Wills in NYS do not need to be notarized. They do need to be signed in front of 2 witnesses. The witnesses cannot be beneficiaries under the will; they do not need to know the contents of the will - just that it is your will and you are competent and willingly signing it.

The witness' signature can be notarized - which just states that those particular witnesses witnessed you signing the will, but the will itself is not notarized.

Nope, totally blank docs. I dont even get as far to ask about the witness portion.

I Was hoping a notary or attny would chime in to tell me if there is a reason.

It's hard to really answer this without seeing what exactly you're asking them to notarize. Generally, a notary is not supposed to look at the contents of what is being signed, but just attesting that your did in fact the sign the document. Are you asking them to witness the will? Because that is a whole different thing and they could be called to testify in court as a witness that you signed the will and that you declared it as your last will and testament. As stated previously, in NY wills are not notarized. You just need two disinterested witnesses. However, you can do a self proving affidavit in which the witnesses signatures would be notarized.

The execution ceremony of a will is very important in NY and very technical. Attorneys typically don't charge much for a basic will (most have a standard document that they plug your information into and then they make sure it's executed properly). I know legal zoom may seem simple and cost effective, but you don't want to execute it improperly, and then have it thrown out of probate.

This exactly. I will never notarize a will. I have been a witness at will signing ceremonies more times than I can count. Wills in NYS are not notarized. I understand that you may not want to spend money on having a will prepared but to do it yourself and find it unenforceable is a bigger waste. If there is no large estate and no trusts to be set up, etc., it should be relatively inexpensive. There are so many tiny rules governing wills and their proper execution (from how to staple the pages, the format on the page, etc...) it's important to have a professional handle it
