If you get Severance from work, can you get Unemployment as well?

I have laid people off with severance. I believe you can get unemployment one week after your last payment. I had one employee ask that her severance be paid earlier so that her unemployment could get paid sooner.

Yes but you won't actually get paid until the severance ends. DH had to provide unemployment with the papers detailing his severance and he had to claim every week as if he were getting paid.

Oh no Sandra : (. Make sure you are getting all you deserve. They need to pay you for 2 months on top of your severance or give you two months notice of the layoff and if you have stock options in the hopper, negotiate to get some of those. Unemployment starts after severance is paid. Also make sure how long they are paying your benefits for and contributing to COBRA.

My DH got 5 months severance in a lump sum. He was not able to collect until one week after the 5 months was up.

You will not be paid unemployment until after your severance runs out. NYS will ask you when you file. They do not let you double dip - even if you get paid out in a lump sum. If someone did receive severance and immediate unemployment, then the severance payment was not reported properly to NYS (by either you or the employer).

I remember specifically that i didn't have to wait .
I got 3 months pay. I collected unemployment for 1 month and then got a job.
If i had had to wait for the 3 months severance to run out I wouldn't have collected any unemployment (because I found a job sooner than 3 months) and I know for a fact that I did.
This was 10 years ago...maybe things have changed

Yes, this changed. I got lump chunk severAnce in sept. I had to wait till it ran out to start unemployment. They ask all kinds of details about your severance and if you received a letter from the company detailing severance payment they ask you to mail that in. There is a one week wait period which is the first week you file and you get aid every week for the 26 weeks that you certify.
I'm collecting unemployment now. You must record three different job searches 3x a week and keep track of it. You will also have meetings with unemployment that you must attend.

This exactly. Upon filing, it was questioned by unemployment. Then they ask for a copy of the severence agreement and when you get your letter, they tell you when you are eligible to start collecting.

Thank you for the insight.... I read the comments... my question is... I can basically collect a week after Severance ceases or after the lump sum; what does it mean "wait till it ran out"... does that mean the money was depleted???

KarenK122 - yeah ! this stinks. But after 15 years and made it through all the other layoffs, I feel fortunate, however.... I will fill you in on the 'rest'... #shocked to say the least.

It's based on how many weeks the severAnce is for. So if you get 6 months you then file on 6m1w. Your letter should spell out how many weeks you get.
