Short term disability during maternity leave

If you have a private short term disability plan, will they pay you if you're out 12 weeks? Does the doctor have to write 12 weeks on the paperwork they fill out for disability? When the doctor filled out my FMLA paperwork they were only willing to write 6-8 weeks because that is I guess the amount of time it takes to heal postpartum. Wondering if they'll give me a problem filling out my short term disability paperwork and I won't be able to get my payments for the full time I'm out. Which will stink because this whole time I've been paying for short term disability assuming that I will get a check the whole time I'm out.

I could be wrong but I think STD only covers 6 weeks (vaginally) or 8 weeks (c section). Never heard of STD extending longer.

I've never heard of payment for 12 weeks. FMLA I believe protects your job for up to 12 weeks but the disability I believe will only pay you for 6-8 weeks depending on how you deliver. If you want to be paid for the remaining 4-6 weeks you would have to use accrued vacation days.

That's probably right but I wasn't even thinking of that when I signed up for short term disability. The booklet said you can be paid for up to 13 weeks of short term disability so I'm thinking I would be able to use that whole thing but I guess that's if you are injured not for delivery. That stinks

Ditto. That's the coverage I get. I have the option to extend my leave, but I need to use vacation/sick time if I want to be paid.

When I had my son 10 years ago and was working in a corporate office, I was out on bedrest for 4 weeks before I had him, then initially had 6 weeks disability after delivery, but my doctor had me stay out an extra 2 weeks due to complications. So, I did technically get all 12 weeks of disability without having to use vacation time, but that was just because of complications.

So, I did technically get all 12 weeks of disability without having to use vacation time, but that was just because of complications.



My HR department DID mention that I could take FMLA before giving birth, if so ordered by my doctor. One woman even urged me to get a note so that I could stay home with full pay for the last month or so of my pregnancy. Tempting, but I feel too badly to do it, unless of course it's actually medically necessary. But that's entirely separate from the FMLA of maternity leave. Essentially, it would start new the day you give birth.

So if you are out let's say 2 weeks before it doesn't count against your STD? I think I actually only get 5 weeks STD, if that's possible. But then get 9 weeks covered by my company. At least that's what it looks like in my policy.

it depends on your injury that you are on STD for.

For delivery
- Vaginal - 6 weeks
C section - 8 weeks

say you had some sort of other injury not pregnancy then it would depend on the injury.

If you have complications after delivery you could possibly get it extended but it has to be legit....not that you are staying our for the full FMLA time

Probably differences in policies. Mine was pretty standard that you could go out 2 weeks before and then got 6 weeks after for vaginal delivery or 8 weeks for c section. Would pay for longer if medically necessary. Plus, there was also a length of service requirement that determined how many weeks were at full pay before it went to a percentage.

As long as you have a doctor's note stating that you cannot work for those 2 weeks prior to giving birth, yup! The way they look at it, you get 6 weeks (for my company) for a vaginal birth... if you're out 2 weeks on bed rest before that, it's totally separate. You haven't actually given birth so they can't take time away from what you are allotted.

No it's 6-8 weeks unless your doctor tells you it's medically necessary to stay home. STD is up to 13 weeks and anything over that is LTD.
Your dr probably won't write 12 (as in to cover FMLA) bc that's fraud unless you absolutely need it.

There is also a waiting period that you can't get paid for. Most companies have a 7 day wait.
If you're on bedrest I assume it would start. If you're just staying home to stay home, then you probably can work.

Yes, my company has a 5 day wait period. For instance, I'm due to give birth on April 25th. Let's say my doctor gives me a note saying I need to be on bedrest from March 25th until I give birth. I would have to use sick/personal time for the days from March 25th- March 30th. After that, I'm fully covered for STD. If I give birth on April 25th, as scheduled, my maternity leave/FMLA begins ON April 25th and lasts 6 weeks for a vaginal birth or 8 weeks for a c-section. If I choose to stay out longer than those 6 or 8 weeks, with no note from my doctor, I need to use personal/vacation time to get paid. Otherwise, the time would be taken unpaid.

As for the doctor's note for before maternity leave and insurance fraud- that's basically what my HR person was urging me to do- to ask my doctor if I could be given a note saying that I need to be put on bed rest so I can take the time off before giving birth and still be paid. Apparently, it's what MANY people in my office have done. That's why I say I don't feel comfortable doing so unless it actually is medically necessary.

So I think my plan has a 2 week waiting period. Does that mean I'll only get paid for 4 weeks total? I hope I'm not paying more for premiums then I'll be receiving.Chat Icon
