we just had a tree removed. we payed. i would never ask the neighbour to pay any if the tree grew from my yard.

We had a similar situation but the neighbor was not interested in removing or trimming the tree. I was told that I could trim to my property line but that would have looked ridiculous and possibly made the tree unstable. We didn't do anything and during a storm the tree came down, ruining both of our cars and causing $10k damage to my house. Homeowners covered all but deductibles and although the insurance company said it was my neighbors fault bc the tree was on his property we didn't recover deductibles as he didn't have homeowners. It was a costly mistake not to have done something when we first looked into it.

The law is clear. You CAN remove the hanging branches UP TO your property line. But if what YOU do damages the tree you can be help liable.

now, if the branches are causing a liability problem I.E: can fall and hurt you, dead branches then you can do something.

You would have to put the homeowner on notice by mail (registered??) If you put them on notice about the tree and something happens then THEY will have to pay for any damage. If you don't put them on notice and something happens (the tree falls In your yard) then YOU have to take care of any damage out of your pocket.

I remember this for Sandy, so definitely look at the law. I wont say I am an expert and should 100% go by what I say.

The best course of action is speak to the neighbor and see if they would be ok if you trimmed back some of the branches.
