At what point in life do you write a will?

So basically, if something happened to my DH, his family could claim that they will own my house, even though I am still alive - if I don't have a will?


Where do I go to get this? Just any lawyer?



I'm not sure - it would be based on the laws in your state. You'd need to speak to an attorney about it.

We used Al Hans out of Garden City but I'm sure there are a ton of lawyers that do wills & it should be maybe a few hundred dollars since yours seems straight forward.

We just did ours after the birth of our DD. We have been homeowners for several years but didn't think a will was a necessity until possible custody issues arose.

What she said. DH has one he wrote before he was deployed to a war zone, but it hasn't been updated since and I don't have one. We should probably take care of that at some point... and we don't have kids either.

omg no way! we used Al Hans when we bought our house. we didn't get along very well.

to answer op: DH and I bought our house in dec and are just starting to look into making our wills and getting life insurance since we are pg.

I think it is a personal choice but unfortunately you never know what will happen. Your life can change in an instant..

It makes the estate process so much easier if you have one regardless if you have money or not...

I would recommend anyone to get one even if you don't have a family.

Here's something to consider for those that only have bank accounts, no home, no children.

If you & DH were in a car accident, and you were both seriously injured - one of you dies first. The other one still living inherits your money. Later the surviving spouse dies of their injuries. Who inherits the money?

Without knowing estate law but by going on a recent case based on inheritance that was in the news, wouldn't it be the relatives of the last suriving spouse?

In other words, if you are survived by your spouse briefly, would your ILs inherit everything & your family inherit nothing?




This is actually a scenario we were talking about with the estate attorney when we had our wills done.

The other thing to consider if you don't have children is that if your estate is worth more than $1 million (which is not difficult if you own a house on LI and have a decent sized life insurance policy), a large chunk of your estate will go to pay taxes if you die without a will. Having a will could enable you to leave some of your assets to a trust and avoid a large amount of estate taxes, leaving more for your survivors.

We had it drawn up right before we travelled internationally. DH and I have been talking about putting one together and we got our butt in gear when we were going away. We have a house, 2 cars, life insurance plans, retirement plans, and 2 kids. We did it more so we knew who would take care of the kids, trust funds, etc.

I am an attorney so I can answer the Qs over where do I get one. Most attorneys should be willing and able to draft one for you and one for your spouse as well. You will each need one though most times they are called mirror wills b/c they should normally echo what the other says.
