If you don't get a permit

What are the possible consequences of not getting a required permit when you have work done? If you go to sell the house and didn't get a permit, how hard is it to get after the fact?

If you are in the Town of North Hempstead you can apply for a permit now on work already done without penalty, which are usually 4xs the original amount. They are having an 18 month amnesty program which started last July.

No, we're in Smithtown. And for the most part, its work that we are going to have done, not work that's been done already. Just wondering what happens if we don't get the permit (DH thinks its no big deal to not get it. I'm not so sure). So, if you go to get a permit after the fact, there is a penalty that you have to pay?

I know my parents had to get permits after the fact when they wanted to add an addition onto our house...their biggest issue was that they had to then make sure the work is up to the current standards, not the standards when they completed the original work...that can be a pain if things change significantly...Also, part of making sure there are the right permits is to be sure that the work is being done to the standards required by the town...if it isn't, it could mean ripping out work that is complete to do it again the way that the town wants.

If you are planning to sell, get the permits now, we didnt have a permit for our deck, and then found out we needed permits for other things we didnt know we needed. It was a pain because we couldnt close, or we had to put $$ in escrow, and it was stressful.

I think it depends what you are having done. I think exterior it is harder to get away with.

I am in NJ and in our town if you are doing a straight remodel of a kitchen or bath without changing the layout you do not need permits. I think you may be able to get away with this. When we did our previous kitchen we did get permits because we took walls and it was obvious to the house that the layout wasn't original. When we redid the master bath we didn't do permits. We did take down a wall (the shower and toilet was in a room so to speak and the then the sink was kinda in the bedroom) and move plumbing but everything we had done was to code. When we sold we didn't mention that the bathroom was new just the kitchen.

We also decided on our own to get the permits for our front walkway, outdoor fireplace and outdoor grill. We only needed to pay for the permit that was it. They didn't even come and look at it. The permit price was based on the cost of the work.

My architect said he knew people that didn't get permits, and they had to tear down what they did....Chat Icon Chat Icon

Of course "it depends". Some times there will be a penalty,some times they'll make you tear it down, some times they'll just tell you to get a permit, with no repercussions....

We walked away from 2 houses we had deals on because they didn't have permits and we would not be able to get our FHA loan without the proper permits, and the sellers were told it would take up to 6 months if not more to get them. Also, in both instances they found out during this that they were not up to code, or were a few feet off what was 'legal'. It was a HUGE hassle. As someone who went through it from the buyer's side - please get permits! It was 100% a dealbreaker for us and made life so complicated.

I'll echo the please get permits statement. It will save you so much in the long run.. We are currently going through this with a house we are trying to buy and it looks like we may have to walk away.
Whatever work you do today may be perfectly acceptable according to current code but if you sell a few or more years down the road it may not. Not only will you most likely need to pay fines for the permits but you may need a variance, which could take months. You will also need to bring any items you get permits for up to the current code before you can get a CO. It could be extremely costly and time consuming.

Its not work to the actual structure of the house - its re-doing/widening the driveway, and a deck around the pool. Its not like its stuff that we can "hide." I think I've convinced DH to at least call the town about getting the permits.

I believe that if you begin work without a permit, the town can make you stop the work and wait for the permit before you are allowed to complete it, in addition to hitting you with a fine. If you decide to sell one day and do not have permits for work that was completed, you can hire an expediter to get the permits for you.

If you are redoing the deck around the pool I highly suggest you get a permit. There are minimum requirement on fence height and a self closing gate around a pool. So many kids have drowned in pools. I don't think you want to get caught on a safety issue. Most people don't get a permit because they don't want to pay the permit fee or be taxed on it. If the town finds out the fee is 4x the permit fee. If they find out years down the road they might make you pay back taxes on it.
I don't see a problem with the driveway unless if you are moving it. You will have to provide a new survey as well at the completion of all work.

We already have a self closing gate and meet all of the other requirements for the fence around the pool. (the fence is around the wntire yard). We are going to look into the permit for the deck and driveway.

were in the process of buying a house and theres a structure on the property with no permit - were afraid were going to go to closing and the bank attorney is going to ask us to get a co. They can either ask us to tear it down, or get one (obviously after the fact). I know if you go to sell the house as well a lot of people are turned off by anything with no permits - its difficult to get a mortgage sometimes without one

Get permits. You could potentially have to remove them, pay hefty fines or back taxes if they find out down the road. Big headache. If you ever sell, you could required to remove them and/or pay the buyers for the permit issues.

We had to wait to close on our house for the seller to get permits for work he had done. And he had built a nice deck around his pool that had to be torn down bc he didn't have a permit and he wasn't allowed to sell the house without getting rid of the deck.

I agree. I had to have my garage wall rebuilt a few years ago after an unexpected car crash courtesy of a neighbor and the town required a permit. We didn't change ANYTHING. Only had the wall rebuilt, new windows, electricity rewired, new garage doors installed and sprinkler control box replaced. I had to contact the town at the start and end of the construction so that could inspect and approve.

Although it is a hassle and your taxes will increase due to the deck, I definitely would not avoid or wait.

This.....tell your husband it's worth the fee, the back taxes, and any potential issues you could have. God forbid a neighbor see's the work and knows you didn't get a permit (since most of that is Public Record) they can report you and you will keep getting fines until you get the permit. So NOT worth it in the long run.

If you dont get a permit, you deserve what you get.

There are reprocusions for not doing so. Most will rear their head if you sell.

Its NOT worth saving, what $150?

ETA: I really wanted to say that it can cause HUGE fines and problems down the road. Its NOT worth it.

My house is almost 100 years old and there are no permits and to get permits for a pool I need to get permits for my 100 year old house which will cost me upwards $7000 (which is a lot more than the price of the pool)... I don't understand why they want me to file for permits on the house (which is grandfathered) to add a pool to the property. The pool is not an addition to the house and doesn't change the house. This is just a way for the county to collect more money. As if my property tax wasn't enough.

The house we had bought had an above ground pool w/o a permit. The sellers had to tear it down to comply prior to closing. I guess they are lucky that we as buyers did not care if the pool was there or not, but I could imagine it would cause problems for a buyer that wanted the pool there.
