This post confuses me though.
Right now my company is not mandating anything. So let's say I get laid off today due to a cost cutting layoff. Not because I'm not vaccinated, because the company has layoffs.
Can I get unemployment?
Is this no unemployment only if you are let go due to not following a company policy of getting vaccinated?



If you are let go for a cost cutting layoff, you can still get unemployment (well, there are other things like severance and whatnot that may impact that but, your vaccination status will not impact it).



The problem is that for most people they were working at these jobs, paying unemployment taxes, long before a covid vaccination mandate. It's truly unfair to say that you can't collect unemployment when the company changes a policy or puts a new policy in place and you are let go because of it. For example, if your company relocates to another city and you don't want to make the move, you qualify for unemployment. This has to be illegal.



That's what I was thinking too. Just like you pay into social security every check. Can they just say- oh guess what, you can't collect social security now! Ha ha tough shit
It's nonsense .
And the more people that see it and fight it, the better.

Yup. We are leaving as soon as we can, in about 2.5 years. I am vaccinated, but this is all getting to be a little much. Like 2 year old babies being forced to wear masks all day in daycare.

Technically the unemployed should be actively looking for work (which I think is clearly not happening because of the major labor shortage, but I digress).
If someone is unvaccinated, there are many positions that they are no longer eligible to work. Also, many may have lost their jobs due to being unvaccinated.

Furthermore, if you lose your job because of a mandate, the employer should not have to pay for your unemployment. It is unfair to the employer - mandate that they fire staff but then also pay for their unemployment.

Bottom line, it is someone's choice to refuse a vaccine, but as with everything in life there are consequences.

NY won’t be the only state denying unemployment benefits to those who fail to comply with their employer’s mandate.

FDNY currently requires vaccines for new hires so it would only impact those who are active and were on the job before the pandemic. But they had a lot of retirements as well and have a lot of vacancies to fill already…

You might be thinking of schools not allowing them for students.

A federal judge issued an injunction the other day to prohibit health care employers from enforcing the vaccine mandate without giving consideration to religious exemptions. As long as religious exemptions are considered, it looks like the vaccine mandate is enforceable right now. A different federal judge denied a request for a preliminary injunction by teachers to stop enforcement of a mandate in part because religious exemptions were allowed to be considered by their employers.
