Maternity issues

I am hoping to get a FT job for September. What are the guidlelines for maternity leave and stuff. I was thinking it is best to wait until you are tenured especially because I will probably want more than 12 weeks off or whatever it is. Others are trying to convince me it is not a big deal to get pregnant like your second year or something. I just don't feel comfortable doing that and I thought we were going to start now (I had a m/c) but we decided to wait so now I just want to figure out how long I will most likely be waiting...Chat Icon

It can depend upon the district but yes, you will be in a much better position if you are tenured.

Every district interprets things differently but they must follow the FMLA which is 12 weeks unpaid. If you want more time off than that, unpaid, you most likely need to be tenured

As far as all of the other variables it does depend. Most districts have it outlined in their contract.
Many make you use your sick days concurrent with FMLA until you run out. For many women just starting out teaching that could be 20-30 days max.

I got very, very lucky but then again I've been in my position for 10 years and have a slightly more complicated issue because it's a multiples pregnancy... it's just not safe to work up to the due date so I had to be able to leave early. I also have A LOT of sick days after ten years. Our contract, as of right now, doesn't have a limit as to how many you can use. I was very lucky in how the asst. supt. interpreted things. I don't want to post the details but it was the best possible outcome/interpretation.

I have been told by teachers in other districts that the limits contained in their contracts would never allow for what I got.

Best thing you can go it speak to your building's union rep.

that's a great questions, thanks for asking.

the teacher I am covering got 6 weeks paid, 8 weeks if a c-sec. She worked until the birth so she could save her sick days. that's such a short amount of time off.

I never thought I'd plan it...but I think we might plan and have the baby towards the end of the school year, so you have the summer off with the baby.

I got pregnant my tenure year and had DS in May so I only took off 4 weeks and the school year was over. I got tenure -no problem. But I'd be much more nervous if it was my 1st or 2nd year teaching.
However, I just returned to work after 9 and 1/2 weeks with my 2nd son yesterday. I used up all my sick days (40) and had to return b/c i couldn't go unpaid.
If you have 60 days(12 weeks) in your sick bank you can take them and get paid. You won't get paid for the days that you don't have in the sick bank.

This is why so many women in my district try to give birth towards the middle/end of March so they can use 60 days of the FMLA which will take them to the last week of school, then they also have the rest of the summer. Of course, not all of us can set our ovaries to our watches.

Keep in mind, because we don't always work 5 day weeks and get off for several vacations, FMLA is interpreted as 60 work days in our situation which is often more than 12 calendar weeks.

You don't have to wait to be tenured.
I know women who got pregnant, were untenured, and had no problems returning to their position.


A SD does not what the legal nightmare that could ensue if they denied a teacher her tenure due to maternity.

Yeah I know that it sounds good on paper, planning. Chat Icon we have time. we don't expect to start trying until fall of 08

The FMLA interpretation is to our advantage!!!

Wow you are lucky. Our district only allows us to use 6 weeks of sick days for a natural birth and 8 weeks for a c-section. If someone has to go out early, their sick days start from that point in time.

You also have to be careful with having a child at the end of the school year and benefits. I have a friend that came back for the last 2 weeks in June to ensure that she had her medical benefits for the summer and got paid for the summer.

I was told that it's 6 weeks unpaid maternity leave. Can you use your days in CAR instead of taking an unpaid maternity leave if you have the days in your bank??

I work for the city. I got pregnant my second year teaching and had James in August, one day before teachers were due in. I did not want to put my life on hold for tenure. I was afraid that if I waited for everything to be perfect and for me to get tenure, what if I had trouble becoming pregnant? So since I wanted a baby, I started trying. I was lucky and got pregnant right away. Even without tenure, everthing was fine. As for time off, you get 12 weeks FMLA. The only bad thing about going out on maternity with only 2 years on is that you don't have that much saved in your bank. NYC maternity s*cks, and they don't pay you ANYTHING, except what is in your bank. So I got paid for my sick days, borrowed some and then the rest was unpaid. Good luck!!

So I understand....do you get paid when on maternity leave only if you have sick-days to use, or by law do they pay you for at least the 6 or 8 weeks?

It depends on the district, but NYC does not pay you anything except what is in your sick bank. Gotta love the maternity policy! Chat Icon By law you can take up to 12 weeks, but your company does not have to pay you.

wow I had no clue! Thanfully I am good with not taking off....hopefullyI'll stay that way when that time comes.

Very well said. A good friend of mine was in the situation and got tenured. She even took a leave of absence after her FMLA was up. The only drawback for her was that they pushed back her tenure date because of her extended leave, and as a result she dropped on the senority list. This is one more thing to consider. If lose your seniority - you can be excessed if the district decides to make cuts.

This depends on how your district decides to handle FMLA leave. However, if the school was closed for one or more weeks during your absence, that period of time does not count towards your FMLA leave.

Also, keep in mind that you are not eligible for FMLA protections until you've worked for your employer for at least 1 year and have worked at least 1250 hours. You may, however, be eligible for other maternity leave benefits under your contract.

In general, your information is correct. There are cases where the information in a contract or certain benefits of a particular district superceed FMLA. Or, that particular teacher has been there for so many years and if there are no limits on how many sick days (full pay, full benefits) they may take (according to contract) and said teacher has well over 60 days then FMLA might be a mute issue. It's very rare but it can happen.
