martenity leave-small office

How long do you get for your martenity leave? I understand that under the FMLA you get a total of 12 weeks unpaid leave. My job has no martenity plan right mainly since anyone who works here can not have children anymore. I am hoping to have a meeting with my boss and we can figure out some type of deal. I do plan on using my 2 weeks vac time. Any advise would be great

I know I get 3 months which I believe is the Norm without Pay but NYSTATE DISABILITY pays you for 6 out of the 12 Weeks itsz not much but its something i think its like 200 a Week

I worked with a small office with DD - just 3 of us.. my old boss took all business advise from her acct who mistakenly told her that she needed to hold my job for the 12 weeks- which isn't true as that only applies to companies w/ more than 50 people.

I was able to take disability for 6 weeks for the c-section, and I only stayed out for 2 months.

that's exactly what I plan on doing too.

8 weeks total, 6 wks will be paid at NYS Disability ($170/wk before taxes, about $143 after)

There are only 4 employees in my office

ETA: I'm using vacation days to supplement the 2 wks I won't be receiving any pay

I work for a small company (9 of us). I plan on taking the 6 weeks I get from NYS disability for a vaginal birth. Then I do plan to take another 6 weeks but it will be paid but working from home. There is no way I can leave my baby at home before the 12 weeks. I have yet to speak to my boss but I don't see him having a problem since I will be helping him out anyway.

If there are less than 50 employees, you're not eligible for FMLA. You are considered disabled by NYS for 6 or 8 weeks depending upon the type of birth you have. I'd ask for 12 weeks of leave. The worst thing that could happen is that your boss says no. Good luck. Chat Icon

You sound as confused as I was in the beginning. MOST companies do not pay you on materinety leave. Once you "go out on maternity" you collect your piddly $140 a week from NYSD. After your 6 weeks bonding with your baby or 8 weeks depending on how you give birth, you should go back to work (since you are no longer disabled). You may be able to extend your leave if your company allows it by adding on your vacation and sick time, but that needs to be arranged with your employer, especially if you are in a company with less than 50 employees. Otherwise any time you choose to stay home after disability ends is unpaid. This is why I took out an AFLAC policy to supplement the 140 dollars that clearly will not pay for my rent.Chat Icon Sometimes I am not a fan of our country

so wait....i work for a middle sized office. we're just shy of 50 employees. so do they HAVE to hold your job for 12 weeks or not? i wanted to take the 12 weeks but one of my coworkers that had a baby last year said our boss told her that he didnt want her taking any more than 8 weeks so thats what she did.

If there are fewer than 50 employees, you're not eligible for FMLA and they do not have to hold your job for 12 weeks.

since I went out towards the end of the year, my old boss gave me a very generous holiday bonus early (like 5k)... that helped tide us over.

then when I went back to work I had a ton of time off she allowed me to roll over- which I used the first few weeks to work 4 day weeks.

ETA: For the original poster, unless your lucky, your maternity leave is UNPAID by your company. The only money you will get is from NYS Disability if you apply.

When I looked into it you need to have had it at least a year before even getting PG. Plus it was costly based on your salary level - at least my plan was at my old company.

I know they don't HAVE to hold your job, but check your employee manual. I work for a small office - 7 in my immediate office, about 20 total for the company I believe - but in our handbook it states you can take up to 12 weeks off - unpaid thoughChat Icon
We can use any personal time or vacation time but that's it.
