If the sidewalk isn't shoveled, is the mailman allowed to skip your mail delivery?

Not that I blame him, but our sidewalks weren't done. I saw the mail truck stop infront of our building, wait a minute, and then leave.

Of course, the shoveling service came a few minutes later, but the mailman never came back today, so no one got mail delivered.

Have you ever heard of this happening?

Yes. at least in our town, it's true. we get a flier in our mailbox each year about it. Since our mailbox is at the street, we need to have at least 6-feet of clearance so the mail truck can get close enough to the box. That's a lot of shoveling for us when the plows come!

BTW, we are in the Town of Oyster Bay.

Yes, unfortunately. Even for the mailmen that drive around, if they can't access their mailbox easily (by foot or from their vehicles) then can skip delivery for you.

they don't have to deliver the mail if the walkway isn't shoveled.

I never received a notice (I'm in NJ).

Last time it snowed, the sidewalks still weren't done by the time I got home from work. I was surprised because I saw the mailman's foot prints- he still walked around the complex and delivered the mail.

Considering we pay a hefty association fee and they are getting worse and worse with the shoveling (now to the point that I can't get my mail delivered), should I complain??

Due to hazards or inconveniences postal carriers may refuse, officially or otherwise, to deliver mail to a particular address (for instance, if snow buildup obstructs the clear path to the door or mailbox).

Yes. Also, if you start to clear part of your property, and then someone slips on another part, you can be sued.

A few years back we had a bad ice storm and my mom was able to clear her stoop, front walk and most of her sidewalk, but just couldn't manage this one part that was a thick sheet of very slick ice. The mailman fell on it, broke his arm, and sued her homeowner's. She was told that if she hadn't cleared anything he would not have been able to sue her.

I drive DH nuts now about making sure that all sidewalks have a clear path now.

I am sitting next to DHs best friend right now and he is a mailman. He said he doesnt go to the house if there is snow on the walkway or it might be a problem for him to get to the mailbox, he doesnt have to deliver.

I'm not sure you can complain since they DID shovel.

There's probably nothing that says WHEN they have to shovel, just that they do.

Sucks you didn't get your mail though.

Even in FL if the mail carrier cant reach your mailbox they wont deliver.

A few months ago the city was redoing our streets and down the block their was a house being built. So between the construction, and the rain my neighbors mailbox was surrounded by mud. The mail carrier put a notice in their mailbox that told them to either move their mailbox closer to the street, get rid of the mud or throw sand over the mud.

My neighbor was so mad because the mailbox is across the street from the house on land that belongs to the city, next to a house that is being built that she has nothing to do with and the mud that was caused by rain. But the mail carrier who puts the mail in the box from her car didnt want to stretch or lean over mud so she didnt deliver the maill until it met with her needs.

yeah it happens all the time. if you dont do snow removal you dont get mail.

same thing happened to my parents. and my dad was fuming because he was supposed to get his tax refund in the mail! he said he is making a complaint against the mailman on monday... he watched the guy fly down the block and not stop at any of the houses, and everything had been cleared. it was a replacement mail person though, not their usual lady. see, i thought they had to deliver no matter what.

Yep-our landlord never shoveled the steps or sidewalk today and we did not get the mail.

The last ice storm we had on Valentines day we couldn't move any of it... the mailman didn't come. I can't blame him though.
