It doesn't really matter what you say in an interview, even if they call your prior employer it is illegal to disparage a former employee. You can only give the dates they worked there.

Not saying anyone should lie...



I don't believe that's true. Some companies have internal policies that they will not provide anything more than dates for liability reasons as they are concerned about slander suits, but it is not illegal to do so if it is factual.

a question that can get asked and get answered are whether the employee is eligible for rehire.... if they were fired, they wouldn't be.

Yea but just because a place wouldnt rehire you doesnt mean you were fired. My last job wouldnt rehire if you left without giving 2 weeks notice or because you had an issue with another team member. Doesnt mean you were fired

Yes that is true, it doesn't 100% mean they were fired.

However, it is a piece of information that doesn't reflect well on the applicant.
